Izvršenje alternativne sankcije uslovna osuda sa zaštitnim nadzorom

Abstract

Мастер рад под називом “Извршење условне осуде са заштитним надзором” садржи осам тематских целина и један прилог. Сам увод рада нас уводи у детаљнију анализу појма санкције са становишта историје и филозофије и описан је огроман пут који су прошле санкције са циљем ретрибуције до појаве алтернативних кривичних мера и санкција са циљем превенције и ресоцијализације. Друга глава се бави теоријским одређењем појма условне осуде, њеног настанка и развоја, као и њен однос са другим санкцијама. Трећи део обухватио је појам, могућности и начин спровођења условне осуде са заштитним надзором, улогу повереничке службе као и услове изрицања и опозивања условне осуде. У четвртом делу је појашњен начин вођења казнене евиденције у случају условне осуде и условне осуде са заштитним надзором. У петој глави је објашњена примене условне осуде у законодавству Републике Србије са табеларним прегледима из Матичне књиге коју води Одељење за третман и алтернативне санкције и кратку анализу о полу и старости извршилаца, о броју изречених и испуњених условних осуда са заштитним надзором као и преглед за која је конкретна кривична дела најизрицанија. Критички осврт и примедбе упућене условној осуди са заштитним надзором представљени су у шестој глави овог рада док се седма глава односи на истраживање које је вршено са циљем бољег схватања алтернативних санкција и како би се сазнало који су позитивни и негативни примери из праксе из визуре самих повереника. Последња глава сумира значај условне осуде са заштитним надзором и настоји да укаже важност постојања таквог система санкционисања и његове предности у односу на правне системе са изразито репересивним елементима у казненој политици.

"Execution of a suspended sentence with protective supervision" contains eight thematic units and one attachment. The very introduction of the paper introduces us with a more detailed analysis of the concept of sanctions from the standpoint of history and philosophy and describes the huge path that sanctions have gone through with the aim of retribution to the emergence of alternative criminal measures and sanctions aimed at prevention and resocialization. The second chapter deals with the theoretical definition of the concept of probation, its origin, and development, as well as its relationship with other sanctions. The third part included the concept, possibilities, and manner of conducting a suspended sentence with protective supervision, the role of the trust service as well as the conditions for pronouncing and revoking a suspended sentence. The fourth part explains the manner of keeping criminal records in the case of a suspended sentence and a suspended sentence with protective supervision. The fifth chapter explains the application of probation in the legislation of the Republic of Serbia with tabular reviews from the Registry kept by the Department of Treatment and Alternative Sanctions and brief analysis of the sex and age of perpetrators, the number of suspended sentences with protective supervision. Concrete crimes are the most pronounced. Critical review and remarks addressed to the suspended sentence with protective supervision are presented in the sixth chapter of this paper, while the seventh chapter refers to the research conducted with the aim of better understanding of alternative sanctions and to find out what are the positive and negative examples from practice. The last chapter summarizes the importance of probation with protective supervision and seeks to point out the importance of the existence of such a system of sanctions and its advantages in relation to legal systems with highly repressive elements in penal policy.
