Primena programa radnog angažovanja u penalnoj rehabilitaciji

Abstract

Суштинско питање савремене пенолошке рехабилитације је на који начин се поставити према особама која крше општеприхваћене норме понашања. Друштво је кроз историју различито реаговало на ову дестабилизујућу појаву. Данас је дефинисана сврха, која се жели постићи извршењем казне затвора, а то је да осуђени, применом одговарајућих програма поступања, усвоји друштвено прихватљиве вредности у циљу лакшег укључивања у услове живота после извршења казне, како убудуће не би чинио кривична дела. Један од темеља третмана јесте радно ангажовање осуђених, које се примењује кроз реализацију различитих програма од стране пеналних установа, али и кроз њихову сарадњу са другим заинтересованим странама. Какав је карактер тог ангажовања кроз историјски развој и до којих резултата је довео, какви облици рада се данас примењују и да ли овај сегмент пеналног третмана доприноси крајњем циљу, успешној реинтеграцији осуђених, питања су на која ћемо покушати да одговоримо у овом раду. У раду анализирамо нормативно уређење области радног ангажовања осуђених у Србији и сагледавамо усаглашеност законских норматива са принципима радног ангажовања и њихову примену у пракси пеналне рехабилитације; значај радног ангажовања у пеналном третману; врсте послова на којима се осуђени могу упослити; проблеме који оптерећују упошљавање осуђених и обим радног ангажовања осуђених. Правимо осврт на решења и могућности радног ангажовања осуђених у државама у региону, са циљем компаративног прегледа у односу на Србију. Сагледаћемо могућности примене програма радног ангажовања осуђених, критике на успешност процеса рехабилитације и реинтеграције засноване на овим програмима и резултате истраживања у овој области. На основу прикупљене научне грађе и анализом резултата истраживања, сагледавамо ефективност различитих модалитета и сегмената програма радног ангажовања. Кроз приказ примене програма радног ангажовања у пракси пеналних установа и њихових резултата, утврђујемо да ли програми радног ангажовања треба да остану битан сегмент пеналног третмана, имајући у виду позитивне и негативне резултате њихове примене. У завршном делу, сумирајући претходно изнете резултате, извешћемо закључке са препорукама за успешну примену програма радног ангажовања.

The essential question of modern penological rehabilitation is how to approach people who violate generally accepted norms of behavior. Throughout history, society has reacted differently to this destabilizing phenomenon. Today, the prison sentence has been defined as having the purpose of allowing convicts to adopt socially acceptable values through the application of appropriate treatment programs in order to facilitate inclusion in living conditions after serving the sentence, so that they would not commit crimes in the future. One of the foundations of the treatment is the employment of convicts, which is applied through the implementation of various programs by the penal institutions themselves, but also through their cooperation with other stakeholders. What has the character of this employment been through historical development and what results did it lead to, what forms of work are applied today and whether this segment of penal treatment contributes to the ultimate goal, the successful reintegration of convicts, are questions that we will try to answer in this paper. In this paper, we analyze the normative regulation within the field of the employment of convicts in Serbia and consider the compliance of legal norms with the principles of employment and their application in the practice of penal rehabilitation; the importance of employment in penal treatment; types of work convicts can be employed at; problems that burden the employment of convicts and the scope of employment of convicts. We will be reviewing the solutions and possibilities of employment of convicts in the countries in the region, with the aim of a comparative review in relation to Serbia. We will look at the possibilities of applying the programs of convict employment, criticism of the success of the rehabilitation and reintegration process based on these programs and the results of the research in this area. Based on the collected scientific material and the analysis of research results, we will be assessing the effectiveness of different modalities and segments of the employment program. Through the presentation of the application of employment programs in the practice of penal institutions and their results, we will determine whether employment programs should remain an important segment of penal treatment, considering the positive and negative results of their implementation. In the final part, summarizing the previously presented results, we will report the conclusions with recommendations for the successful implementation of employment programs.
