dc.description.abstractVaspitni nalozi predstavljaju institut diverzionog karaktera koji za svrhu ima da se ne pokreće krivični postupak prema maloletniku ili da se obusta- vi postupak, odnosno da se primenom vaspitnog naloga utiče na pravilan razvoj ma- loletnika i jačanje njegove lične odgovornosti kako ubuduće ne bi činio krivična dela. U dosadašnjoj primeni vaspitnih naloga ispoljile su se značajne teškoće koje se vezuju za neadekvatna zakonska i podzakonska rešenja, nedovoljne resurse za spro- vođenje određenih naloga i neadekvatnu implementaciju pojedinih naloga. Organiza- cije civilnog društva predstavljaju značajan i nedovoljno iskorišćen resurs za aktivno učešće u realizaciji vaspitnih naloga. I pored pogodnih uslova za njihovo uključivanje, najveći broj organizacija se uključuje projektno, a mali broj postiže održivost svojih usluga nakon završetka projektnog finansiranja. U cilju isticanja mogućnosti za unapređenje primene vaspitnih naloga kroz saradnju sa organizacijama civilnog društva, u radu su prikazana iskustva u dosadašnjoj primeni vaspitnih naloga u Srbiji, razmatrana je uloga organizacija civilnog društva u implementaci- ji ovih diverzionih mera i analiziran je predlog standarda za primenu vaspitnih naloga sa stanovišta mogućeg angažovanja organizacija civilnog društva. Na osnovu pregleda literature i kritičke analize, date su preporuke za unapređenje primene vaspitnih naloga kroz saradnju sa organizacijama civilnog društva.
dc.description.abstractEducational orders represent a diversion measure which has the purpose of not prosecuting a juvenile, or suspending the process, that is, using of the educational order to affect the proper development of the juvenile and strengthening his personal responsibility for preventing future crime commiting. Applications of educational orders have demonstrated significant difficulties in their implementation, which can be connected to inadequate sub-legal solutions, insufficient resources for the implementation of certain orders and inadequate implementation of the task itself. CSOs represent a significant and underused resource for the implementation of educational orders. Despite favorable conditions for their inclusion, the largest number of organizations get included through projects, and a small number achieves sustainability of its services after the completion of project financing. This paper presents the experiences in the implementation of educational orders in Serbia, it discusses the role of civil society in the implementation of these diversionary measures and analyzes the proposal of standards for the application of educational orders in terms of the conditions for the engagement of civil society organizations'. Based on a literature review, recommendations were made to improve the application of educational orders through cooperation with civil society organizations
