AB  - Knjiga je prevashodno namenjena studentima Fakulteta za specijalnu edukaciju i rehabilitaciju koji u okviru osnovnih studija pohađaju
nastavu iz predmeta Maloletničko krivično pravo, odnosno studentima
koji u okviru drugih predmeta proučavaju sistem reakcije na maloletničku delinkvenciju. Imajući u vidu da sadrži objašnjenja osnovnih pojmova i instituta iz oblasti maloletničkog krivičnog prava, namenjena je i
ostalim čitaocima koji se u sklopu ostvarivanja sopstvenih obrazovnih i
profesionalnih ciljeva interesuju za datu problematiku.
Izlaganja su koncipirana tako da se značajnim delom nadovezuju na
važeće maloletničko krivično zakonodavstvo u Srbiji, fokusirajući se
pre svega na materijalnopravne i procesnopravne aspekte položaja maloletnih učinilaca krivičnih dela. S druge strane, imajući u vidu kompleksnost fenomena maloletničke delinkvencije koju, između ostalog,
treba suzbijati i sredstvima krivičnopravne reakcije, izlaganja su posvećena sumiranju ključnih teorijskih pogleda na uzroke ove izuzetno značajne društvene pojave. Određeni prostor posvećen je i uporednoj analizi
različitih pozitivnopravnih rešenja zastupljenih u svetu, i to pre svega
u cilju sumiranja dominantnih modela maloletničkog pravosuđa

AB  - Sažetak: Problem telesnog kažnjavanja dece zaokuplja značajnu pažnju
opšte i stručne javnosti, te otvara moralna, pravna i politička pitanja. Po-
slednjih godina na globalnom nivou jačaju ideje o potrebi potpunog i iz-
ričitog zabranjivanja telesnog kažnjavanja dece. Pobornicima zabrane teles-
nog kažnjavanja suprotstavljaju se oni koji smatraju da uvođenje takve zabrane
istovremeno podrazumeva ograničavanje prava na privatnu i porodičnu sfe-
ru, umanjivanje roditeljskih prava i atak na tradicionalne vrednosti. U ci-
lju svestranog razumevanja fenomena, izlaganja u radu su koncipirana tako da
se telesno kažnjavanja dece sagledava sa pedagoških, socioloških i
međunarodnopravnih aspekata, uz isticanje razloga koji govore u prilog i
protiv telesnog kažnjavanja. Autor je nastojao da ukaže i na prilike u Srbi-
ji, te da iznese lični stav o načinu na koji bi zakon u Srbiji trebalo da se
odnosi prema telesnom kažnjavanju dece.
AB  - The problem of corporal punishment of children occupies significant
attention of general public and professionals, and also opens up moral, legal and
political issues. In recent years, ideas about the introduction of a complete and explicit
prohibition of corporal punishment of children have been strengthening globally.
Proponents of the ban of corporal punishment are opposed by those who believe
that the introduction of a ban implies a restriction on the right to private and
family life and a reduction of parental rights, and also that the ban represents an
attack on traditional values. In order to comprehensively understand the phenomenon
of corporal punishment, presentations in the paper are designed so that corporal
punishment of children is viewed from pedagogical, sociological and international
law aspects, with emphasis on the reasons that speak in favor and against this type of
punishment. The author has also tried to point out to the circumstances in Serbia,
and to express his own position about the way in which the law in Serbia should
treat corporal punishment of children.

Karakteristike maloletnika koji vrše nasilnički kriminalitet

AB  - Uvod: Nasilnički kriminalitet maloletnika privlači pažnju javnosti i stručnjaka svuda u svetu. Posledice nasilja po pojedince i društvo mogu biti ogromne: narušeno zdravlje i kvalitet života, troškovi lečenja, odsustvo s posla, pove- ćan strah od kriminaliteta, zahtevi javnosti za strožim kažnjavanjem učinilaca.
Maloletnici koji vrše nasilnička krivična dela obično ranije ispoljavaju delin- kventno ponašanje, imaju dugotrajne kriminalne „karijere“ i vrše raznovrsna krivična dela.
Cilj: Ukazivanje na problem nasilničkog kriminaliteta maloletnika i na potrebu sagledavanja onih karakteristika nasilnih maloletnika na koje bi trebalo delo- vati putem odgovarajućih programa tretmana i preventivnim merama.
Metod: U radu je dat pregled nalaza istraživanja o nasilničkom kriminalitetu maloletnika. Relevantni radovi su pretraženi i preuzeti iz onlajn baza poda- taka korišćenjem servisa EBSCO, HeinOnline, JSTOR, Oxford Journals, SAGE, Springer-Link i Wiley.
Rezultati: Istraživanja pokazuju da je nasilnički kriminalitet povezan sa men- talnim poremećajima učinilaca, psihopatskim crtama ličnosti, odsustvom sa- mokontrole, emocija i sažaljenja, frustracijom, besom, zavisnošću od alkohola.
Nasilni maloletnici su u velikom procentu i sami žrtve nasilnih krivičnih dela, što je povezano sa kontinuiranom kriminalnom aktivnošću i udruživanjem sa devijantnim vršnjacima. Kada je reč o rodnim razlikama, istraživanja pokazuju da postoji veća verovatnoća da devojčice koje vrše nasilnički kriminalitet žive u depriviranim porodicama, da su bile izložene zlostavljanju i zanemarivanju, da su sklonije samopovređivanju i pokušajima samoubistva u odnosu na dečake koji vrše nasilnička krivična dela.
Zaključak: Postoji potreba za razvojem skrining instrumenata, kako bi se identifikovali maloletnici koji su pod povećanim rizikom vršenja nasilničkog kriminaliteta. Maloletnici koji ispoljavaju ekstremno nasilje drugačije reaguju na tretman u odnosu na maloletnike koji nisu ekstremno nasilni. Oni imaju potrebu za intenzivnijim i dugotrajnijim tretmanom uz aktivnu ulogu porodice u tom procesu.
AB  - Introduction: Juvenile violent crime is attracting the attention of the public and professionals all over the world. The consequences of violence for individuals and society can be enormous: impaired health and quality of life, treatment costs, absence from work, increased fear of crime, public demands for severe punishment of perpetrators. Juveniles who commit violent crimes usually have an early onset of delinquency, persistent criminal careers, and commit a wider variety of crimes.
Aim: Pointing out the problem of juvenile violent crime, and the need to consider those characteristics of violent juveniles that should be addressed through appropriate treatment programs and preventive measures.
Method: The paper presents an overview of research findings on juvenile violent crime.
Relevant articles were searched and extracted from online databases using services EBSCO, HeinOnline, JSTOR, Oxford Journals, SAGE, Springer-Link, and Wiley.
Results: Research shows that violent crime is associated with mental disorders, psychopathic personality traits, lack of self-control, lack of emotions, callousness, frustration, anger, alcohol addiction. A large percentage of violent juveniles are themselves victims of violent crimes, which is associated with continuous criminal activity and association with deviant peers. When it comes to gender differences, research show that girls who commit violent crime are more likely than boys to live in deprived households, to have experienced abuse or neglect, and are more prone to commit self-harm and suicide attempts.
Conclusion: There is a need for development of screening instruments to identify those juveniles who are at increased risk of commiting violent crimes. Juveniles who exhibit extreme violence respond differently to treatment than juveniles who are not extremely violent. They need more intensive and long-term treatment with an active role of the family in that process.

Aim: Pointing out the problem of juvenile violent crime, and the need to consider those characteristics of violent juveniles that should be addressed through appropriate treatment programs and preventive measures.
Method: The paper presents an overview of research findings on juvenile violent crime. Relevant articles were searched and extracted from online databases using services EBSCO, HeinOnline, JSTOR, Oxford Journals, SAGE, Springer-Link, and Wiley.
Results: Research shows that violent crime is associated with mental disorders, psychopathic personality traits, lack of self-control, lack of emotions, callousness, frustration, anger, alcohol addiction. A large percentage of violent juveniles are themselves victims of violent crimes, which is associated with continuous criminal activity and association with deviant peers. When it comes to gender differences, research shows that girls who commit violent crime are more likely than boys to live in deprived households, to have experienced abuse or neglect, and are more prone to commit self-harm and suicide attempts.
Conclusion: There is a need for the development of screening instruments to identify those juveniles who are at increased risk of committing violent crimes. Juveniles who exhibit extreme violence respond differently to treatment than juveniles who are not extremely violent. They need more intensive and long-term treatment with an active role of the family in that process.

Metod: U radu je dat pregled nalaza istraživanja o nasilničkom kriminalitetu maloletnika. Relevantni radovi su pretraženi i preuzeti iz onlajn baza podataka korišćenjem servisa EBSCO, HeinOnline, JSTOR, Oxford Journals, SAGE, Springer-Link i Wiley.
Rezultati: Istraživanja pokazuju da je nasilnički kriminalitet povezan sa mentalnim poremećajima učinilaca, psihopatskim crtama ličnosti, odsustvom samokontrole, emocija i sažaljenja, frustracijom, besom, zavisnošću od alkohola. Nasilni maloletnici su u velikom procentu i sami žrtve nasilnih krivičnih dela, štoje povezano sa kontinuiranom kriminalnom aktivnošću i udruživanjem sa devijantnim vršnjacima. Kada je reč o rodnim razlikama, istraživanja pokazuju da postoji veća verovatnoća da devojčice koje vrše nasilnički kriminalitet žive u depriviranim porodicama, da su bile izložene zlostavljanju i zanemarivanju, da su sklonije samopovređivanju i pokušajima samoubistva u odnosu na dečake koji vrše nasilnička krivična dela.
Zaključak: Postoji potreba za razvojem skrining instrumenata, kako bi se identifikovali maloletnici koji su pod povećanim rizikom vršenja nasilničkog kriminaliteta. Maloletnici koji ispoljavaju ekstremno nasilje drugačije reaguju na tretman u odnosu na maloletnike koji nisu ekstremno nasilni. Oni imaju potrebu za intenzivnijim i dugotrajnijim tretmanom uz aktivnu ulogu porodice u tom procesu., Introduction: Juvenile violent crime is attracting the attention of the public and professionals all over the world. maloletničkom delinkvencijom, što čini i predmet ovog rada. Cilj rada je ukazivanje na značaj ispitivanja
porodičnih faktora rizika delinkvencije, sa posebnim osvrtom na specifičnosti jednoroditeljskih porodica.
AB  - The changes that are happening in modern society have not evaded the family, as primary social
group. According to statistics, the traditional family in some parts of the world is practically disappearing
and giving way to other forms of family structure. Since the last quarter of the 20th century, there has
been a noticeable increase in the participation of single-parent families, as well as an increase in the
interest of researchers in examining the problems of this phenomenon. One of the important issues is the
connection between this form of family structure and juvenile delinquency, which is the subject of this
paper. The aim of this paper is to point out the importance of examining family risk factors for
delinquency, with special reference to the specifics of single-parent families.

AB  - Cilj rada je da prikaže zalaganja civilnog društva za pravnu zaštitu žena od nasilja i
razvoj zakonodavnog okvira za zaštitu žena od nasilja u Srbiji. Zalaganja za pravnu
zaštitu žena od nasilja počela su osamdesetih da bi bila intenzivirana tokom devedesetih
godina XX veka i to zahvaljujući aktivnostima ženskih grupa i feminističkih istraživačica.
Međutim, do prvih zakonodavnih reformi i instrumenata pravne zaštite žena od nasilja
dolazi tek nakon političkih promena 2000. godine, iako u to vreme još uvek nije postojao
jasan strateški okvir i državna politika za zaštitu žena od nasilja. Razvoj državne politike,
ratifikacija Istanbulske konvencije i otvaranje pregovora za pristupanje Evropskoj uniji
(EU) postavili su novi okvir za zalaganja civilnog društva, koja su usmerena na harmonizaciju pozitivnih propisa i politika sa međunarodnim i evropskim standardima i dalje
unapređenje pravne zaštite žena od nasilja. U radu je prvo dat pregled zalaganja civilnog
društva za pravnu zaštitu žena od nasilja, a potom i prikaz razvoja relevantnog zakonodavnog okvira. U zaključnom delu je data ocena postojeće pravne zaštite žena od nasilja i
ukazano na pravce daljih zalaganja.
AB  - The aim of the paper is to provide an overview of advocacy of the civil society in Serbia for legal reforms for better protection of women from violence and
the development of the legislative framework for the protection of women victims of violence. Advocacy for legal protection of women against violence in Serbia
began already in 1980s, primarily due to the activities of women’s groups and feminist researchers. Advocacy activities intensified during the 1990s. In 1994, the Group
for Women’s Rights of the European Movement in Serbia prepared a first draft of
amendments to the laws related to domestic violence and marital rape. Although
not successful, this advocacy was very important in terms of raising awareness of
state officials and general public about violence against women. First legal reforms
and establishment of normative framework for the protection of women against violence, especially domestic violence, sexual violence and human trafficking, occurred only after political changes in 2000. They were initiated and largely based on
drafts written by the experts of the Victimology Society of Serbia. The basis for these
changes was the proposal of a harmonized reform of several laws in order to ensure
criminal, civil and misdemeanour protection of women against various forms of gender-based violence developed in 1998 and further improved after 2000. Advocacy
that followed resulted in first instruments of legal protection of women victims of
violence: domestic violence was foreseen as a standalone criminal offense, restraining orders have been introduced, legal protection against sexual violence has been
improved, and human trafficking was criminalized.
Since the acceptance of Serbia’s EU candidacy and the start of the EU integration process, a strategic framework for the protection of women against violence
has been developed; the protocols for dealing with domestic and intimate partner
violence and other implementation instruments have been adopted, which set up a
basis for more efficient implementation of legal norms in practice. Ratification of the
Council of Europe Convention on preventing and combating violence against women and domestic violence and opening negotiations for the EU accession set a new framework for advocacy and contributed to further improvement of legal protection
of women against violence. Stalking, sexual harassment, female genital mutilation
and forced marriage have been incriminated. The Law on the Prevention of Domestic Violence was adopted, which aims to ensure effective prevention from domestic violence and urgent, adequate and effective protection and support to victims
through improvement of coordination and cooperation between competent services.
This should ensure integrated, multi-sector and human rights-based approach to prevention, prosecution and protection of women victims of violence. Normative framework for the protection of women against violence is to a large extent in compliance
with relevant international standards and the European law. However, it still needs to
be fully harmonized with the Istanbul Convention and other ratified international treaties. On the other hand, it remains to monitor application of legislation in practice in
order to assess its consistency, effectiveness and continue evidence-based advocacy
for further improvement of protection of women victims of violence.

AB  - Kada govorimo o nasilju u školama, obično se misli na vršnjačko nasilje ili nasilje odraslih prema učenicima u školskom okruženju. Nastavnici kao žrtve
nasilja učenika su mnogo ređe predmet interesovanja istraživača i šire javnosti. Prevalenca ovog fenomena nije zanemarljiva. Prema nekim podacima, od
75% do 80% nastavnika osnovnih i srednjih škola tokom svoje karijere pretrpi
neki oblik nasilja od strane učenika. Nastavnici su najčešće izloženi verbalnom,
emocionalnom/psihološkom, fizičkom i socijalnom nasilju. Akti nasilja uključuju
direktno verbalno zlostavljanje, pretnje ili fizički napad, oduzimanje ili oštećivanje imovine, ogovaranje, ignorisanje, ometanje rada. Socijalno nasilje se često sprovodi anonimno, korišćenjem mobilnih telefona, interneta i društvenih
mreža. Pored učenika, kao učinioci nasilja javljaju se i njihovi roditelji. Tamna
brojka ovih pojava je velika jer se nastavnici nerado odlučuju da prijave lakše
oblike nasilja. Nema dovoljno podataka o načinima na koje nadležni u školama
reaguju na prijavljene slučajeve nasilja. Nasilje učenika nad nastavnicima je veoma ozbiljan problem. Istraživanja pokazuju da nasilje nad nastavnicima može
imati dugotrajne negativne posledice po njihovo telesno, psihičko i emocionalno
zdravlje, povezanost sa školom, posvećenost poslu i radni učinak. Predmet ovog
rada je pojava nasilja nad nastavnicima od strane učenika osnovnih i srednjih
škola. Cilj rada je da ukaže na problem nasilja i potrebu istraživanja fenomenologije i posledica nasilja učenika nad nastavnicima.
AB  - Talking about school violence usually refers to peer violence or violence against
students by adults in school environment. Teachers as victims of student violence are less
often of concern to researchers and the general public. The prevalence of this phenomenon
is not negligible. According to some data, 75% to 80% of teachers in primary and secondary
schools have suffered some form of student violence during their careers. Teachers are
usually subjected to verbal, emotional/psychological, physical, and social violence. Acts
of violence include direct verbal abuse, physical threats or assaults, taken or destroyed
property, gossiping, ignoring, obstructions of teacher’s work. Social violence is often
conducted anonymously, using mobile phones, the Internet and social networks. Students’
parents also occur as perpetrators of violence along with students. The dark figure of this
phenomenon is great because teachers are reluctant to report mild forms of violence. There
is not enough information about the ways in which school officials respond to reported cases

mreža. Pored učenika, kao učinioci nasilja javljaju se i njihovi roditelji. Tamna
brojka ovih pojava je velika jer se nastavnici nerado odlučuju da prijave lakše
oblike nasilja. Nema dovoljno podataka o načinima na koje nadležni u školama
reaguju na prijavljene slučajeve nasilja. Nasilje učenika nad nastavnicima je veoma ozbiljan problem. Istraživanja pokazuju da nasilje nad nastavnicima može
imati dugotrajne negativne posledice po njihovo telesno, psihičko i emocionalno
zdravlje, povezanost sa školom, posvećenost poslu i radni učinak. Predmet ovog
rada je pojava nasilja nad nastavnicima od strane učenika osnovnih i srednjih
škola. Cilj rada je da ukaže na problem nasilja i potrebu istraživanja fenomenologije i posledica nasilja učenika nad nastavnicima., Talking about school violence usually refers to peer violence or violence against
students by adults in school environment. Teachers as victims of student violence are less
often of concern to researchers and the general public. The prevalence of this phenomenon
is not negligible. According to some data, 75% to 80% of teachers in primary and secondary
schools have suffered some form of student violence during their careers. Teachers are
usually subjected to verbal, emotional/psychological, physical, and social violence. Acts
of violence include direct verbal abuse, physical threats or assaults, taken or destroyed
property, gossiping, ignoring, obstructions of teacher’s work. Social violence is often
conducted anonymously, using mobile phones, the Internet and social networks. Students’
parents also occur as perpetrators of violence along with students. The dark figure of this
phenomenon is great because teachers are reluctant to report mild forms of violence. There
is not enough information about the ways in which school officials respond to reported cases

AB  - U duhu preovlađujućih ideja o potrebi diverzionog i neinvazivnog postupanja
prema maloletnim prestupnicima, primena mera restorativne pravde sve više
dobija na značaju. Ne samo da postoji snažno konceptualno opredeljenje za
što širu primenu restorativnog pristupa, već i sve veći broj empirijskih istraživanja
ukazuje na njegove pozitivne efekte, posebno u pogledu suzbijanja recidivizma.
I pored navedenog, uočava se tek skroman porast broja primenjenih
restorativnih mera iz godine u godinu, što važi kako za Srbiju, tako i za neke
zemlje iz našeg bližeg i daljeg okruženja. Čini se da praktični problemi u implementaciji
dominantno utiču na to da restorativne mere ne budu primenjene
na širi i sadržajniji način. Stoga su izlaganja u radu posvećena upoznavanju
kako normativnih okvira, tako i praktičnih iskustava u primeni mera restorativnog
karaktera u Hrvatskoj, Austriji i drugim državama. Cilj rada jeste da se
na osnovu izvršene analize izdvoje određene preporuke koje bi bile primenljive
u Srbiji.
AB  - Nowadays, with the ideas about diversion and non-invasive measures as best possible
solutions for the treatment of juvenile offenders, the concept of restorative justice gains
special importance. There is a strong conceptual commitment to the widespread use of
the restorative approach and there is also an increasing number of empirical surveys that
point to its positive effects, especially in terms of suppressing recidivism. Despite this, only
a modest increase has been observed in the number of applied restorative measures, which
one could say for Serbia as well as for some other countries. It seems that problems in the
sphere of practical implementation dominantly affect the state in which restorative measures simply do not get to be applied in a wider and more meaningful way. Therefore, the paper is
devoted to the analysis of normative frameworks and practical experiences in the application
of restorative measures in Croatia, Austria and other countries. The aim of the paper is to
point out certain recommendations that could be applicable in The Republic of Serbia.

The data was collected with the useof the standardised question­ naire, while respondents were students who couldwork in the criminaljustice system.In Serbia, the survey was conducted on
a sampleof 188 students of the third and fourth year of the un­ dergraduate studies at three faculties in Belgrade: the Faculty of Special Education and Rehabilitationand the Faculty of Phi·
losophy, Department of Psychology (University of Belgrade)  and the Faculty of Law (University Union).The questionnaire in­
cluded three scales of attitudes: towards lesbians and gay men, towards crime and towards criminalsanctions. The aim of the chapter is to present a part of the survey findings conceming students' attitudes towardslesbians and gay men.The Herek (1998) Scaleof Attitudes towards Lesbians and Gay Men was used in the survey. Itconsisted of 20 different statements, ten about gay men and ten aboutlesbians, to which respondents indicated theirlevel of agreement or disagreement on a 5-point Likert-type scale. The paper starts with an overview of the avail­ ableso far research on the students' attitudes towards lesbians and gay men.This is followed with a brief overview of the sur­ vey methodology. Afterwards, the survey findings on students' attitudes towardslesbians and gay men and contributingfac­  tors are presented and discussed. Inthe final part, the main
condusions are pointed out, aswellas recommendations relat­ ed to the necessity of raisingawareness about the rights of per­ sons of different sexual orientation in the field of higher educa­ tion and the importance of sensitizing future professionals who couldwork in the criminaljustice system.

Podaci su prikupljani putem ankete, primenom standardizovanog upitnika na uzorku stu­ denata koji

studenata  i studentkinja trece icetvrte godine tri fakulteta u Beogradu: Fakulteta za speci·
jalnu edukadju irehabilitadju, Filozofskog

Viktimizacija studenata u sajber prostoru: Iskustva iz Srbije

AB  - Inspiracija za rad i problem koji se radom oslovljava: Život savremenog čoveka neza-misliv je bez sredstava savremene tehnologije. Pored nespornih prednosti života u eri digitalizacije, sajber prostor predstavlja ujedno i veoma rizičnu sferu mogućih zloupo-treba, manipulacija i različitih oblika viktimizacije. Mladi, kao najbrojniji korisnici sred-stava informacione tehnologije u najvećem su riziku kako od njihove zloupotrebe, tako i od viktimizacije u sajber prostoru.
Ciljevi rada (naučni i/ili društveni): Rad ima za cilj predstavljanje dela rezultata istraži-vanja viktimizacije studenata Univerziteta u Beogradu. Dobijeni rezultati mogu poslužiti kao dobra osnova za identifikovanje negativnih iskustava studenata u sajber prostoru, te osmišljavanje preventivnih strategija u cilju edukovanja studenata i eliminacije nji-hove sajber viktmizacije.
Metodologija/dizajn: Istraživanje je eksplorativnog karaktera, realizovano primenom kvantitativne metodologije, na uzorku od 338 studenata svih nivoa studija na fakulte-tima iz svih naučnih oblasti Univerziteta u Beogradu.
Ograničenja istraživanja/rada: Ograničenja istraživanja proizilaze iz ograničenje prime-njenih tehnika za prikupljanje podataka. Iako nesumnjivo korisne za saznavanje tamne brojke kriminaliteta, anketa o viktimizaciji i sa samoprijavljivanjem nasilja imaju svojih nedostataka, a koji se ogledaju u nespremnosti priznavanja viktimizacije i nasilnog po-našanja, kao i subjektivnosti ispitanika (“greške” u pamćenju, različito percipiranje pi-tanja od strane različitih ispitanika i sl.)
Rezultati/Nalazi: Rezultati pokazuju da je većina ispitanika doživela neki oblik sajber viktimizacije, te da se u većini slučajeva radi se o višestrukoj viktimizaciji učinjenoj od strane nepoznatih osoba. Takođe, ispitanici prijavljuju i viktimizaciju partnerskim nasi-ljem u sajber prostoru koje se najčešće ogleda u primeni različitih kontrolnih taktika. Istraživanjem je utvrđena povezanost između viktimizacije u realnom životu i sajber prostoru, sa posebnim akcentnom na prediktorskom efektu iskustva nasilne viktimiza-cije.
Generalni zaključak: Može se zaključiti da su studenti u visokom riziku od sajber vikti-mizacije različitim pojavnim oblicima, pri čemu su najzastupljeniji oni oblici koji se tre-tiraju kao teža krivična dela. To ukazuje na potrebu za realizacijom obuhvatnijih istra-živanja na uzorku ove kategorije mladih i osmišljavanja njima prilagođenih preventivnih strategija u cilju sprečavanja kako njihove viktimizacije, tako i ispoljavanja kriminalnih ponašanja u sajber prostoru.

Additionally to the undeniable advantages of life in the digitalization era, cyberspace also represents a very risky domain of possible abuse, manipulation and various types of victimization. Young people, as the largest users of information technology assets, are at the highest risk of their misuse and victimization in cyberspace
Aims of the paper (scientific and/or social): This paper aims at presenting a part of re-search findings which relate to the experiences of victimization of Belgrade University students in cyberspace. The results obtained can serve as a good basis for identifying characteristics of negative experiences of students in cyberspace, and planning preven-tive strategies aiming to eliminate students' cyber victimization.
Methodology/Design: The research is exploratory in nature, implemented using a qu-antitative methodology, on a sample of 338 students of all levels of study at faculties from all scientific fields of the University of Belgrade.
Research/paper limitations: The limitations of the research comes from the limitations of the techniques used for data collection. Although undoubtedly, useful for finding out the dark crime figures, victimization surveys and self-report surveys have their li-mitations, which are reflected in the unwillingness of the respondents to admit victi-mization and violent behaviour, as well as the subjectivity of the respondents (“mistakes” in memory, different perception of questions by different respondents etc.).
Results/Findings: The results show that more than half of the respondents had the experience of victimization in cyberspace during the studies. Mostly, it was multiple victimization committed by unknown perpetrators. Additionally, respondents reported a cyber IPV victimization, mostly manifested in a form of different control tactics. Cor-relation between victimization in real life and cyberspace, with particular emphasis on the experience of violent victimization, was also found.
General conclusion: It can be concluded that students are at high risk of different forms of cyber-victimization, with the most prevalent those forms than can be treated as se-rious crimes. This indicates the need for more comprehensive research on a sample of this category of young people and the development of preventive strategies adjusted to them in order to prevent their victimization and the perpetration of criminal

Metodologija/dizajn: Istraživanje je eksplorativnog karaktera, realizovano primenom kvantitativne metodologije, na uzorku od 338 studenata svih nivoa studija na fakulte-tima iz svih naučnih oblasti Univerziteta u Beogradu.
Ograničenja istraživanja/rada: Ograničenja istraživanja proizilaze iz ograničenje prime-njenih tehnika za prikupljanje podataka. Iako nesumnjivo korisne za saznavanje tamne brojke kriminaliteta, anketa o viktimizaciji i sa samoprijavljivanjem nasilja imaju svojih nedostataka, a koji se ogledaju u nespremnosti priznavanja viktimizacije i nasilnog po-našanja, kao i subjektivnosti ispitanika (“greške” u pamćenju, različito percipiranje pi-tanja od strane različitih ispitanika i sl.)
Rezultati/Nalazi: Rezultati pokazuju da je većina ispitanika doživela neki oblik sajber viktimizacije, te da se u većini slučajeva radi se o višestrukoj viktimizaciji učinjenoj od strane nepoznatih osoba. Takođe, ispitanici prijavljuju i viktimizaciju partnerskim nasi-ljem u sajber prostoru koje se najčešće ogleda u primeni različitih kontrolnih taktika. Istraživanjem je utvrđena povezanost između viktimizacije u realnom životu i sajber prostoru, sa posebnim akcentnom na prediktorskom efektu iskustva nasilne viktimiza-cije.

AB  - Ubistva ţena izdvajaju se svojim osobenostima od ostalih oblika ubistava i neretko su u
bliskoj vezi sa fenomenom rodno zasnovanog nasilja, te iziskuju primenu posebnih mera prevencije i
reakcije. Ubistvo ţena u Srbiji takoĊe predstavlja izraţen i opasan društveni problem. Relevantni
meĊunarodni dokumenti istiĉu u prvi plan princip duţne paţnje koji obavezuje drţave da preduzmu
sve što je u njihovoj moći da spreĉe ubistvo ţena, odnosno da sprovedu kriviĉni postupak i kazne
uĉinioce pošto je kriviĉno delo izvršeno. S obzirom da se naĉelu duţne paţnje u opisanom kontekstu u
Srbiji do sada nije posvećivala potrebna paţnja, predmet rada jeste analiza obaveza koje drţava u
vezi sa tim naĉelom ima. Poseban akcenat stavljen je na praksu Evropskog suda za ljudska prava, koji
je već presuĊivao u korist oštećenih onda kada su se drţave oglušile o naĉelo duţne paţnje. Cilj rada
jeste da se izdvoje odreĊene preporuke koje bi mogle unaprediti praksu.
AB  - Femicide is characterized by a number of specific features which set it apart from the other forms of
murder and it is closely linked to the phenomenon of gender-based violence, so that it calls for the
implementation of specific measures of prevention and reaction. The killing of women in Serbia is also
a growing and dangerous problem. The principle of due diligence obliges states to do everything in
their power to prevent femicide, and also to prosecute and punish the perpetrators of this heinous
crime. The principle of due diligence regarding femicide has not been given the due consideration in
Serbia, so the subject of this paper is the analysis of state obligations in relation to that principle.
Special emphasis is placed on the practice of the European Court of Human Rights and the
judgements in favor of the victims in cases when states have breached the principle of due diligence.
The aim of this paper is to set aside recommendations that could improve the practice in Serbia

AB  - Sažetak: Polno uznemiravanje predstavlja veoma aktuelan problem svuda u
svetu, dodatno naglašen time što međunarodnopravni dokumenti pred države sta-
vljaju zahtev da adekvatno zaštite svoje građane. Međutim, reč je o fenomenu koji nije
dovoljno istražen, niti precizno definisan, što dodatno komplikuje osmišljavanje
strategija za njegovo suzbijanje. Imajući u vidu navedeno, izlaganja u radu su konci-
pirana tako da se nakon uvodnih razmatranja o polnom uznemiravanju daje komparati-
vni pregled zakonskih rešenja prisutnih u različitim zemljama, nakon čega sledi
osvrt na Srbiju. Cilj rada jeste da se primenom analitičko-sintetičkog pristupa
ukaže na ključne probleme i nedoumice u vezi sa inkriminisanjem krivičnog dela
polno uznemiravanje u Srbiji, kako bi se došlo do odgovarajućih preporuka čija bi
primena mogla doprineti boljoj zaštiti prava i sloboda građana u polnoj sferi.
Autor ipak zaključuje da se ne treba oslanjati na krivično pravo kao dominantno
sredstvo zaštite u ovoj oblasti
AB  - Summary: Sexual harassment is widely known as a very serious issue of great social
significance. According to international legal documents states have an obligation to
adequately protect their citizens from sexual harassment, as well as to take action to
minimize the consequences of sexual discrimination, as much as possible. However, this is a
phenomenon that has not been sufficiently explored, nor precisely defined, which
additionally complicates the elaboration of the strategies for its suppression. Bearing in mind
the above, after the introductory consideration on the phenomenon of sexual harassment, the
author gives a comparative overview of the legal solutions present in different countries,
followed by a review of serbian law and its inconsistencies. The aim of the paper is to point
out to key problems and concerns related to the criminalization of sexual harassment by
applying the analytical-synthetic approach in order to stipulate appropriate recommendations
that could contribute to better protection of the rights of citizens in the sphere of sexual
freedom and human dignity.

AB  - Modern technology has provided us with unlimited possibilities for audio and visual recording, which can, unfortunately, also be used for the violation of human rights and freedoms. With the agreement of involved parties, the use of the recording is likely to be uncontroversial. However, complex issues arise when the recording is covert, and when the recording party wants to rely upon the recording, or the transcript of it, to prove an illegal act in court proceedings. The question arises as to how to strike a balance between the need to protect security and investigate the truth and the need to protect the right to privacy and the personal sphere. Particularly interesting legal issues are those that concern the justification and the permissibility of the use of illegal or covert recordings in the capacity of evidence in criminal proceedings. Bearing in mind the above, the paper is devoted to the analysis of legislation concerning protection of privacy and the legislation on the subject of illegal evidence in criminal proceedings. This issue is especially interesting due to the fact that Serbian criminal law accepts the theory of "the fruits of the poisonous tree", which means that the criteria for the evaluation of the validity of the evidence are particularly strict. In that context, the normative, axiological and comparative law method has been used to analyse the subject matter. The author has also referred to the comparative law and to the practice of the European Court of Human Rights. The aim of the paper is to point out to the certain ambiguities in Serbian positive law, in order to develop appropriate recommendations for the practical use and for the improvement of normative solutions.
AB  - U savremeno doba tehnologija daje neograničene mogućnosti za beleženja zvučnih i vizuelnih zapisa, ali i za kršenje ljudskih prava i sloboda. Stoga se autor bavi pitanjem kako postići ravnotežu između potrebe da se zaštiti bezbednost i spozna istina, s jedne strane, i potrebe da se zaštiti pravo građana na privatnost i ličnu sferu, s druge strane. Autor posebno skreće pažnju na probleme u vezi sa dozvoljenošću upotrebe privatnih neovlašćeno sačinjenih snimaka u svojstvu dokaznog materijala u krivičnom postupku. Imajući u vidu navedeno, autor analizira legislativu o zaštiti privatnosti i legislativu koja se tiče dokaznih zabrana u krivičnom postupku i zaključuje da su u srpskom pozitivnom pravu zastupljene određene nedorečenosti i nejasnoće, ali da se privatno sačinjeni snimci u načelu mogu koristiti kao dokaz. Korišćen je normativno-dogmatski, aksiološki i uporednopravni metod, a radi sadržajnije obrade teme autor se osvrnuo i na praksu Evropskog suda za ljudska prava. Rezultat analize su određene preporuke za unapređenje postojećih rešenja.

This issue is especially interesting due to the fact that Serbian criminal law accepts the theory of "the fruits of the poisonous tree", which means that the criteria for the evaluation of the validity of the evidence are particularly strict. In that context, the normative, axiological and comparative law method has been used to analyse the subject matter. The author has also referred to the comparative law and to the practice of the European Court of Human Rights. The aim of the paper is to point out to the certain ambiguities in Serbian positive law, in order to develop appropriate recommendations for the practical use and for the improvement of normative solutions., U savremeno doba tehnologija daje neograničene mogućnosti za beleženja zvučnih i vizuelnih zapisa, ali i za kršenje ljudskih prava i sloboda. Stoga se autor bavi pitanjem kako postići ravnotežu između potrebe da se zaštiti bezbednost i spozna istina, s jedne strane, i potrebe da se zaštiti pravo građana na privatnost i ličnu sferu, s druge strane. Autor posebno skreće pažnju na probleme u vezi sa dozvoljenošću upotrebe privatnih neovlašćeno sačinjenih snimaka u svojstvu dokaznog materijala u krivičnom postupku. Imajući u vidu navedeno, autor analizira legislativu o zaštiti privatnosti i legislativu koja se tiče dokaznih zabrana u krivičnom postupku i zaključuje da su u srpskom pozitivnom pravu zastupljene određene nedorečenosti i nejasnoće, ali da se privatno sačinjeni snimci u načelu mogu koristiti kao dokaz. Korišćen je normativno-dogmatski, aksiološki i uporednopravni metod, a radi sadržajnije obrade teme autor se osvrnuo i na praksu Evropskog suda za ljudska prava. Rezultat analize su određene preporuke za unapređenje postojećih rešenja.",

AB  - Diversion for juvenile offenders is a standard in almost all relevant international documents in the field of juvenile justice. However, the modes of practical implementation can drastically affect the meaning and purpose of diversion. If diversionary treatment is reduced to a factual forgiving of the responsibility for crime committed by minors, without the support and a positive influence for the further development of the minor, then the diversion is reduced to a mere formality and it has been deprived of its point. The process of the application of diversionary practices can easily be affected by the lack of resources, primarily at the local level, which means that there are no meaningful programs for juvenile offenders. The aim of this paper is to look at certain experiences from comparative systems, in order to detect those measures that have been proven to be adequate. In order to achieve this goal, an analyticalsynthetic, dogmatic and comparative method has been applied.
AB  - Diverziono postupanje prema maloletnim učiniocima krivičnih dela predstavlja standard za koji plediraju gotovo svi relevantni međunarodni dokumenti iz oblasti maloletničkog pravosuđa. Međutim, načini praktične implementacije mogu drastično da utiču na smisao i svrhu diverzionog postupanja. Ukoliko se diverziono postupanje svede na faktičko opraštanje odgovornosti i zaboravljanje krivičnog dela učinjenog od strane maloletnika, a izostanu pomoć, podrška i makar pokušaj da se pozitivno utiče na dalji razvoj maloletnika, onda je i diverzija svedena na puku formu i lišena poente. Ono što posebno pogubno može da utiče na primenu diverzionog postupanja jeste nedostatak resursa, pre svega na lokalnom nivou, usled čega izostaju smisleni programi za maloletne učinioce krivičnih dela. Cilj rada jeste da se sagledaju određena iskustva iz uporednopravnih sistema, kako bi se i u Srbiji razmišljalo u pravcu primene onih mera koje su se pokazale kao adekvatne. Primenjen je analitičko-sintetički, pravno-dogmatski i komparativni metod.

Violence against Women and Teaching at Higher Education Institutions in Serbia

AB  - The paper has two aims. It aims to present first steps in introducing the topic of violence against women in higher education institutions in Serbia as well as to present results of exploratory research about the current situation regarding the place that violence against women as a topic has in teaching at the selected higher education institutions in Serbia. In the first part of the paper, the first time inclusion of this topic in one criminology textbook and the syllabi at the Law Faculty (University of Nis) in 1998, and later (2004) at the Faculty for special education and rehabilitation - FASPER (University of Belgrade) is described. The importance of the cooperation of the author of this paper and professor Slobodanka Konstantinovic Vilic, persons and circumstances that were beneficial for their ideas to be realized, as well as further development of teaching about violence against women at these faculties is emphasized. In the second part of the paper current state of teaching about violence against women at the Law Faculty (University of Nis) and FASPER is examined within a larger context of the situation at similar faculties in Serbia. The analysis is focused on the visibility of the violence against women topic in the syllabi of the faculties of three state universities: University of Belgrade, University of Nis and University of Novi Sad. Apart from the Nis Law Faculty and FASPER, the analysis included the law faculties of the University of Belgrade and University of Novi Sad, as well as Special education and rehabilitation studies at the Faculty of Medicine in Novi Sad. The analysis is based on the data contained in the syllabi (undergraduate, master and doctoral level) that were available online on the internet sites of the given faculties in October 2018. Qualitative analysis of the syllabi was performed. It included the following data: course title, goals, outcomes, content and reading materials. The results suggest that violence against women topic is included in teaching at the majority of the faculties encompassed by the study, while at the same time there is inconsistency in dealing with different forms of violence. The topic of domestic violence is the most common, while sexual violence and trafficking in people (women) are less present. Some faculties have courses specifically dealing with either domestic violence or trafficking in people. Other forms of violence against women, such as stalking, work-related abuse and violence against women in general, are rarely present in syllabi, i.e. only at certain faculties. We can assume that these topics are only sporadically taught, or are not taught at all. The topic of violence against women is most prominent in undergraduate level syllabi, while it is somewhat less represented on the master level and in doctoral studies. However, on the other side, some master courses are completely or largely devoted to topics related to violence against women (e.g. courses called Domestic violence and Trafficking in people). The main weakness is the fact that most of the courses that have violence against women as a part of their syllabi are optional courses, which means that all students are not educated for adequate dealing with violence against women in their future practical work. Based on the study results, the author concludes that the current situation regarding the inclusion of the violence against women topic is better than twenty years ago. However, it is necessary to conduct larger and more detailed study in order to give reliable estimation of whether education that future professionals obtain at faculties in Serbia is appropriate to assure adequate social response to violence against women in terms of its suppression, prevention and victims support.

хуманијег односа према учиниоцима кривичних дела. Истовремено, применом алтернативних санкција и мера омогућава се активније укључивање жртве и заједнице у процес
реинтеграције и социјалне инклузије учинилаца, што је важан предуслов за уздржавање
од криминалног понашања и спречавање поврата. Циљ овог рада је анализа законодавног оквира и примене алтернативних санкција и мера у односу на пунолетне учиниоце
кривичних дела у Србији. За потребе рада, под алтернативним санкцијама и мерама
подразумевају се кривичне санкције и мере које се извршавају под окриљем друштвене
заједнице, које суд изриче након спроведног кривичног поступка, чија је примена заснована на претпоставци да се циљеви кажњавања могу постићи и без казне затвора или
новчане казне, а које укључују контролу, надзор и подршку осуђеном лицу. Сходно томе,
у раду се анализирају рад у јавном интересу, условна осуда са заштитним надзором и
извршење казне затвора у просторијама у којима осуђени станује, са или без електронског надзора. На почетку је дат кратак преглед захтева, стандарда и принципа садржаних у међународним документима релевантним за примену алтернативних санкција.
Потом се анализира законодавни оквир, а онда и примена алтернативних санкција и
мера у пракси, и то на основу података које прикупљају Републички завод за статистику и Савет Европе (SPACE II). У закључном делу се указује на могуће даље кораке у
правцу обезбеђивања шире примене алтернативних санкција и мера у Србији.
AB  - The use of alternative criminal sanctions and measures (community sanctions and
measures) is considered to be one of the possible ways of reducing prison population and
addressing the problem of prison overcrowding, rationalization of the procedure and a more
humane treatment of offenders. At the same time, the use of alternative sanctions and measures allows more active involvement of the victim and the community in the process of reintegration and social inclusion of offenders, which is an important prerequisite for desistance
and prevention of recidivism. The aim of this paper is to analyse normative framework and
application of alternative sanctions and measures for adult offenders of criminal offenses in
Serbia. Community service, suspended sentence with protective supervision and the execution
of imprisonment in the premises where the convicted person resides, with or without electronic monitoring, are analysed. These criminal sanctions and measures are implemented in the
community, they are imposed by the court after the criminal proceedings, and their use is based on the presumption that the purpose of punishment can be achieved without imprisonment or fine. They also include control, supervision and support for the convicted person,
which is the essence of community santions. The paper starts with a brief overview of relevant
international documents that set forth obligations, standards and principles for implementing
alternative sanctions and measures. It proceeds with the analysis of the normative framework,
and then with the analysis of implementation of alternative sanctions and measures in practice
in Serbia, which is based on the available statistical data collected and published by the Statistical Office of the Republic of Serbia and the Council of Europe Annual Penal Statistics SPACE II. In the conclusion, some possible steps for future broader use of alternative sanctions
and measures in Serbia are pointed out.

Abduction of a minor and criminal law reaction

AB  - Criminal prosecution for the abduction of a minor should additionally protect the child's right to live with his parents, or other authorized caregivers, and also to maintain contact with parents or other relatives and close people. The paper is designed to explain the reasons justifying the existence of this incrimination. Some general considerations are given in the introductory part, with a review of the relevant international documents. The central part of the paper is devoted to the analysis of positive law in the Republic of Serbia, with particular emphasis on the mutual relationship between the criminal offense of abduction of the minor and the criminal offense of kidnapping, and to the analysis of controversial issues that arise in the judicial practice. The aim of the paper is to point out the real possibilities of criminal law protection in this sphere, as well as to emphasize the need to respect the letter of the law without loose and extensive interpretation in the judicial practice.
AB  - Krivično gonjenje za krivično delo oduzimanje maloletnog lica trebalo bi dodatno da zaštiti pravo deteta na život sa roditeljima, odnosno drugim ovlašćenim starateljima i na održavanje kontakta kako sa roditeljima, tako i sa drugim srodnicima i bliskim licima. Postavlja se pitanje da li se prava deteta u ovoj oblasti mogu adekvatno zaštiti primenom krivičnog prava. Stoga je rad koncipiran tako da su u uvodnom delu u formi opštih razmatranja navedeni određeni razlozi koji opravdavaju postojanje navedene inkriminacije, uz osvrt na relevantne međunarodnopravne dokumente. Centralni deo rada posvećen je analizi pozitivnopravnih rešenja iz srpskog krivičnog zakonodavstva, uz posebno akcentovanja međusobnog odnosa krivičnog dela otmice i krivičnog dela oduzimanje maloletnog lica, te ukazivanje na sporna pitanja koja se javljaju u sudskoj praksi. Cilj rada jeste da se ukaže na realne mogućnosti krivičnopravne zaštite u ovoj sferi, kao i da se naglasi potreba za poštovanjem slova zakona bez odveć ekstenzivnog tumačenja u praktičnoj primeni.

Postavlja se pitanje da li se prava deteta u ovoj oblasti mogu adekvatno zaštiti primenom krivičnog prava. AB  - Interest for the phenomenom of stalking has been on the rise over recent years, especially because it can sometimes be turned into serious crimes. This is why an increasing number of countries are opting for the introduction of new incriminations that will include stalking. However, the incrimination of persecution opens the problem of distinguishing this criminal offense from other related criminal offenses, and the question arises as to how the offense should be defined so that there is no excessive limitation of other rights and freedoms of citizens. Therefore, the paper is focused on general considerations concerning stalking and on the analysis of comparative solutions. Given that in Serbia stalking has been incriminated only recently, the aim of the paper is to point out to some of the problems that can be expected in practice, and to extricate some possible solutions.
AB  - Interesovanje za problem proganjanja je u porastu tokom poslednjih godina, posebno imajući u vidu da proganjanje ponekad samo prethodi izvršenju drugih teških krivičnih dela. Zbog toga se sve veći broj država opredeljuje za uvođenje novih inkriminacija koje će obuhvatiti proganjanje. Inkriminisanje proganjanja, međutim, otvara problem izdvajanja i razlikovanja navedenog krivičnog dela od drugih srodnih dela, a postavlja se i pitanje kako radnju krivičnog dela proganjanja trebalo opredeliti tako da ne dođe do preteranog ograničavanja prava i sloboda građana. Stoga su izlaganja u radu posvećena opštim razmatranjima o proganjanju, te analizi uporednopravnih rešenja. S obzirom na to da je u Srbiji proganjanje tek nedavno inkriminisano, cilj rada jeste da se ukaže na neke od problema koji se u praksi mogu očekivati, te na pravce za iznalaženje mogućih rešenja.

Raising Awareness of Prisoners about Restorative Justice and Victims: An Example of the Program Implemented in the Women's Prison in Serbia

AB  - Restorative justice is implemented in a variety of fields, contexts and situations. One possible way of implementing restorative justice is seen in introducing restorative approaches into the prison settings. It is argued that restorative justice can add more humanity into the prison system; it may help in treatment of prisoners and contribute to their preparation for the release and easier reintegration and social inclusion. Introducing victims' perspective, either through their direct involvement in restorative justice programs in prisons or through working on raising awareness of inmates about victims and their rights, needs and feelings, contributes to increase of the visibility of victims, their empowerment and healing. Taking that as a starting point, the article aims at presenting one possible way of introducing restorative justice into the prison setting through raising awareness programs for prisoners about restorative justice and victims' rights, which are implemented in some European and non-European countries. It particularly focuses on presenting the program on raising awareness about the impact of crime on a victim and on restorative justice, which was developed by the Victimology Society of Serbia as a part of its long-term advocacy and support to female prisoners. This is an integrated, gender-sensitive program developed in the spirit of positive criminology and victimology. It was piloted in 2015 in the women's prison in Serbia. The program was implemented in a form of a series of six workshops followed by evaluation interviews with female prisoners who took part in the entire program. The program evaluation suggested that participants improved their overall knowledge related to victims; they also showed the desire to apologize to person(s) they had hurt and they recognized that the program had influenced them to change in a positive way, especially in terms of diverting from hurting others by a crime or other harmful acts. Participants also recognized the potential of restorative mechanisms in their relationship with their own victims, but also with other people. Evaluation showed that participants used learnt skills after the program ended, particularly communication skills in the spirit of restorative justice, focusing on the present moment and yoga nidra. Development and delivery of the victim awareness raising program piloted in the women's prison in Serbia proved to be valuable learning experience. Keeping in mind lessons learnt, it is obvious that there is a need for broader use of restorative justice approaches in prison settings for both adults and juveniles in Serbia.

AB  - Nasilje u porodici predstavlja ozbiljan društveni problem, pa je Krivičnim
zakonikom Republike Srbije inkriminisano ponašanje kojim se ugrožava spokojstvo,
telesni integritet ili duševno stanje člana sopstvene porodice. Značaj,
opasnost, ali i kako se čini sve češća zastupljenost ovog patološkog ponašanja,
čine da se u medijima sve češće govori o nasilju u porodici. Pri tome novinski
članci i televizijski prilozi neretko insistiraju na pojedinostima koje oslikavaju
surovost nasilnika ili na pojedinostima koje će pre svega skandalizovati
javnost, uz zanemarivanje izveštavanja koje bi ukazivalo na uzroke pojave i
načine da se ona spreči i suzbija. Čini se da izveštavanje u medijima pre svega
služi podizanju rejtinga i ostvarivanju dobiti, dok se edukativna funkcija i
odgovorno i argumentovano obaveštavanje povlače u drugi plan. Navedeno
ne utiče povoljno na prosvećivanje stanovništva, niti na razvoj sposobnosti
za adekvatno reagovanje u slučaju susretanja sa nasiljem u porodici. Stoga
je u radu predstavljen normativni okvir koji se odnosi na nasilje u porodici i
na izveštavanje medija, nakon čega sledi analiza načina na koji o nasilju u
porodici izveštavaju neki od naših najpopularnijih medija. Rad se završava
određenim preporukama čija primena bi mogla unaprediti ovu oblast.
AB  - Domestic violence is a serious social problem, so The Criminal Code of the Republic
of Serbia has criminalized violent behaviour which endangers tranquility, physical
integrity and mental condition of a member of the family. In our media everybody
is talking about the domestic violence. At the same time, newspaper articles and TV
programs often have often insisted on details that portray the cruelty of the perpetrator
or on the details which would primarily scandalize the public, while at the same time the
kind of reporting that would indicate the causes of domestic violence and emphasize
the ways to prevent and combat this behaviour has been disregarded. It seems that
the reporting in the media has primarily served to boost the rating and increase the
profit, while the educational function has retreated into the background. The above
does not benefit the education of the population, nor the development of the capacity
for adequate response in the event of encountering domestic violence. Therefore,
the paper presents the normative framework related to domestic violence and the
media coverage of it, followed by analysis of the ways in which domestic violence has
been displayed in some of the most popular media. The paper concludes with some
recommendations whose implementation could improve this area.

AB  - The paper deals with rights and position of victims in international documents, with special reference to the standards created by the European Court of Human Rights through its practice. This paper aims to provide brief analysis of some of the most important international documents, which set forth basic rights for victims, including: right to participate in the criminal proceedings, right to protection and the right to compensation. The paper intends to analyze these key right (standards, principles) through relevant case law of the European Court of Human Rights, given that the wording of the relevant documents does not determine what entails the realization of a specific standard in real life. The main purpose of the article is to examine the compliance of regulations and practices in Serbia with international standards on the status and the rights of victims, from which some recommendations for improvement might arise.
AB  - Rad se bavi pravima i položajem žrtava u međunarodnim dokumentima, sa posebnim osvrtom na standarde koje je kreirao Evropski sud za ljudska prava kroz svoju praksu. U radu su sumarno analizirani neki od najznačajnijih međunarodnih dokumenata iz kojih, kao osnovna prava žrtava, proističu: pravo na učešće u krivičnom postupku, pravo na zaštitu i pravo na nadoknadu pretrpljene štete. Nastojalo se da ključni standardi budu ilustrovani analizom odgovarajućih sudskih slučajeva iz prakse Evropskog suda za ljudska prava, s obzirom da se izsamog teksta relevantnih dokumenata zapravo ne može zaključiti šta realizacija jednog standarda u stvarnom životu podrazumeva. Osnovni cilj rada je analiza usaglašenosti propisa i prakse u Srbiji sa međunarodnim standardima o položaju i pravima žrtava, iz čega bi mogle proizaći određene preporuke za unapređenje postojećih prilika.

The paper intends to analyze these key right (standards, principles) through relevant case law of the European Court of Human Rights, given that the wording of the relevant documents does not determine what entails the realization of a specific standard in real life. The main purpose of the article is to examine the compliance of regulations and practices in Serbia with international standards on the status and the rights of victims, from which some recommendations for improvement might arise., Rad se bavi pravima i položajem žrtava u međunarodnim dokumentima, sa posebnim osvrtom na standarde koje je kreirao Evropski sud za ljudska prava kroz svoju praksu. U radu su sumarno analizirani neki od najznačajnijih međunarodnih dokumenata iz kojih, kao osnovna prava žrtava, proističu: pravo na učešće u krivičnom postupku, pravo na zaštitu i pravo na nadoknadu pretrpljene štete. Nastojalo se da ključni standardi budu ilustrovani analizom odgovarajućih sudskih slučajeva iz prakse Evropskog suda za ljudska prava, s obzirom da se izsamog teksta relevantnih dokumenata zapravo ne može zaključiti šta realizacija jednog standarda u stvarnom životu podrazumeva. Osnovni cilj rada je analiza usaglašenosti propisa i prakse u Srbiji sa međunarodnim standardima o položaju i pravima žrtava, iz čega bi mogle proizaći određene preporuke za unapređenje postojećih prilika.",

AB  - The public has the right to be informed about the work of the judiciary, and about the outcome and course of the criminal proceedings, especially when it comes to serious crimes, and crimes committed by public figures. Similarly, defendants have rights which must not be violated by inadequate reporting. The balance between timely and complete information for the public and respect for the rights of defendants ought to be achieved, and also freedom of expression with the smooth progress of the criminal proceedings. Therefore, the aim of this paper is to present the normative framework regulating this area in Serbia, and also to present the practice of the European Court of Human Rights relating to the articles 6 and 10 of the European Convention for the Protection of Human Rights and Fundamental Freedoms. The paper concludes with some recommendations for the improvement of the practice in the Republic of Serbia.
AB  - Javnost ima pravo da bude upućena u rad pravosuđa, odnosno u ishod i tok krivičnih postupaka, posebno kada su u pitanju teška krivična dela, kao i krivična dela izvršena od strane javnih ličnosti. Isto tako, i okrivljeni imaju svoja prava koja ne smeju biti povređena neadekvatnim izveštavanjem i olakim iznošenjem pretpostavki. Treba naći pravu meru između blagovremenog i potpunog informisanja i poštovanja prava okrivljenih, to jest omogućiti slobodu izražavanja uz neometano odvijanje krivičnih postupaka. Stoga je cilj rada da se predstavi normativni okvir koji uređuje ovu oblast u Srbiji, te da se u našim uslovima analizira primena standarda koje je osmislio Evropski sud za ljudska prava u svojoj bogatoj praksi u vezi sa čl. 6. i 10. Evropske konvencije o zaštiti ljudskih prava i osnovnih sloboda. Iz navedenog na kraju proizlaze određene preporuke za unapređenje postupanja.

AB  - In recent decades, one of the key trends in the field of juvenile justice is the diversion from the criminal procedure. The aim of this paper is to present the basic elements of diversion model of juvenile justice, with reference to the current situation in Serbia. The author presents basic ideas and theoretical concepts underlying the application of diversion measures, and also numerous international documents in the field of juvenile delinquency and juvenile justice relating to this issue, as well as some examples of comparative law. The central part is devoted to the application of educational orders in Serbia. The author has endeavored to summarize the structure and trends in the application of educational orders, and also the key problems that characterize this area in Serbia. The paper concludes with specific recommendations for the improvement of the practice in Serbia.
AB  - Poslednjih decenija jedna od ključnih tendencija u oblasti reagovanja na maloletnički kriminalitet odnosi se na traženje alternativa za standardni krivični postupak. Stoga je cilj ovog rada da se predstave osnovni elementi diverzionog koncepta postupanja prema maloletnim prestupnicima, uz osvrt na aktuelne prilike u Srbiji. Autorka je predstavila dominantne ideje i teorijske koncepcije na kojima počiva diverziono postupanje, te ukazala na međunarodne dokumente iz oblasti maloletničkog prestupništva koji se odnose na ovu problematiku, kao i na određene primere iz uporednog prava. Centralni deo rada je posvećen praksi u primeni vaspitnih naloga u Srbiji. Autorka je nastojala da ukratko prikaže strukturu i tendencije u primeni vaspitnih naloga, te ključne probleme koji odlikuju ovu oblast u Srbiji. Rad se završava određenim preporukama za unapređenje prakse u našoj zemlji.

AB  - In the literature, as well as in international statistical surveys, we can rarely find more detailed information on juvenile delinquency in the Russian Federation, as well as on the criminal reaction towards juvenile offenders. Due to the turbulent conditions and great social turmoil which took place in the last few decades in this country, there should be a greater interest in the problem of juvenile delinquency. For Serbia, the experience of the Russian Federation could be especially important if one bears in mind that our country is still going through a transition, population stratification and through economic crisis, and also that Serbia and the Russian Federation share some cultural and religious similarities. Therefore, the aim of this paper is to present, in the summary way, the basic features of juvenile delinquency and the criminal justice system, and thereby build a basis for future research and comparison.
AB  - U literaturi, kao i u internacionalnim statističkim pregledima, retko pronalazimo detaljnije podatke o maloletničkom kriminalitetu u Ruskoj Federaciji, kao i o načinima reagovanja na ovaj značajan problem. S obzirom na turbulentne prilike i velika društvena previranja koja su se u poslednjih nekoliko decenija odvijala u ovoj državi, trebalo bi da postoji veće interesovanje i za problem maloletničkog kriminaliteta. Za Srbiju bi iskustva Ruske Federacije mogla biti posebno značajna, ukoliko se ima u vidu da je i naša zemlja prolazila i još uvek prolazi kroz tranziciju, raslojavanje stanovništva i ekonomsku krizu, pri čemu Republiku Srbiju i Rusku Federaciju vežu kulturne, verske i druge sličnosti. Stoga je cilj rada da se na sumaran način predstave osnovne odlike maloletničkog kriminaliteta i ustrojstvo i funkcionisanje sistema formalne reakcije u Ruskoj Federaciji, te da se time izgradi baza za neka buduća istraživanja i poređenja.

AB  - The development of positive psychology, a new direction in psychology, marked the beginning of a positive movement in the social sciences, having an impact on the development of criminology and victimology thought. This article presents basic principles of positive psychology, the study of positive emotions, positive character and institutions that make this possible. Additionally, the aim is to analyse the contribution of positive psychology to positive victimology. The author is of the opinion that the positive psychology approach may contribute to positive victimology in shifting the focus from weaknesses and risks to positive elements that promote recovery and post traumatic growth of the victim.
AB  - Razvoj pozitivne psihologije, novog pravca u psihologiji, označio je početak pozitivnog pokreta u društvenim naukama koji je imao uticaj na razvoj kriminološke i viktimološke misli. U ovom radu su predstavljeni osnovni principi pozitivne psihologije, studije o pozitivnim emocijama, pozitivnom karakteru i institucijama koje to omogućavaju. Cilj rada je, takođe, analiza doprinosa pozitivne psihologije pozitivnoj viktimologiji. Autorka smatra da pristup pozitivne psihologije može doprineti pozitivnoj viktimologiji u pomeranju fokusa sa slabosti i rizika na pozitivne elemente koji promovišu oporavak i posttraumatski rast žrtve.
