Seksualno nasilje nad studentima na fakultetima u Srbiji

AB  - Verujem kako smo se svi koji radimo na području seksualnog nasilja
u 2021. i 2022. godini suočili s jednim novim izazovom – konačno otvaranje teme seksualnog uznemiravanja i drugih oblika seksualnog nasilja
na fakultetima.
Svetska kampanja #metoo, koja je prerasla u društveni pokret protiv
seksualnog nasilja i kulture silovanja, imala je svoje različite odjeke i u
regionu, kao što su, na primer, #spasi me, #nisam tražila, #nisamprijavila. Poslednje dve kampanje putem društvenih mreža imale su značajan
uticaj kroz medijsku prisutnost, mobilizaciju žena koje su preživele nasilje, prostor za obelodanjivanje ličnih iskustava. Međutim, imale su uticaj
i na same fakultete. Značajan broj studentikinja odlučio je da iznese svoja
iskustva. I nešto se pokrenulo.
Odjednom su neki hrabriji fakulteti, njihove dekanice i dekani bili
spremni za promenu. Stupili su u kontakt sa specijalizovanim (ženskim)
organizacijama koje rade na području seksualnog nasilja, tražili sugestije
i savete oko razvoja normativnih i institucionalnih procedura, dogovorili edukacije za studentkinje i studente, kao i za nastavno osoblje, počeli
upućivati studentkinje koje su preživele seksualno uznemiravanje i druge
oblike seksualnog nasilja u specijalizovane službe, prijavili slučajeve nadležnim institucijama. Broj pitanja i zahteva od strane različitih fakulteta
je rastao iz meseca u mesec.
Sa druge strane, broj istraživanja o seksualnom uznemiravanju na
fakultetima u zemljama regiona je veoma redak, najčešće na malim, nereprezentativnim uzorcima, zadržavajući se na nivou prevalence i/ili incidence određenih oblika seksualnog uznemiravanja. Nedostajao je ozbiljan pregled postojećih svetskih istraživanja, nedostajali su primeri dobre
prakse, konkretne ideje šta i kako je nužno učiniti na fakultetima, ako
stvarno kao društvo želimo promenu. A povrh svega, sistemski gledano,
nedostaju specijalizovane službe i usluge za rad sa osobama koje su preživele seksualno nasilje.
Svi mi koji godinama radimo na ovom području imali smo jasnu sliku
da je potreban „celovit paket“. Naime, same normativne procedure, bez
podizanja svesti i edukacija neće učiniti ništa. Edukacije, bez normativ-

nog okvira prave samo dodatnu zbrku. Nedostatak specijalizovanih mesta
za podršku osobama koje su preživele seksualno uznemiravanje i seksualno nasilje na fakultetima dovodi ih u poziciju da nakon otvaranja priče,
nemaju gde da potraže stručnu pomoć i podršku na putu oporavka, ali i
za pomoć da prijave nasilje. Klima na nekim od fakulteta nije ni najmanje
bila naklonjena studentkinjama koje su otvoreno počele izlaziti sa svojim
iskustvima.
I onda se dogodi da mi dođe u ruke na recenziju knjiga Seksualno nasilje nad studentima na fakultetima u Srbiji, koja sadrži rezultate istraživanja
koje je sprovelo Viktimološko društvo Srbije, ali i puno više od toga. Prva
misao kada sam pogledala knjigu bila je – gde ste bili do sada?!
Knjiga je ozbiljna, sveobuhvatna, jasna, naučno utemeljena, metodološki jako kvalitetna, s ozbiljnim poštovanjem savremenih etičkih standarda. Autorke se ne zadržavaju samo na rezultatima istraživanja, koji su
veoma vredni, nego nude konkretne preporuke šta i kako učiniti na nivou
univerziteta i fakulteta u zajedničkom nastojanju usmerenom na suzbijanje seksualnog nasilja i podršku osobama koje su ga preživele.
U knjizi su izneti objedinjeni ključni podaci za sve koji žele stvarno
nešto promeniti na ovom području. Dakle, ne samo za akademsku zajednicu, nego i za praktičarke i praktičare, ključne aktere iz sistema visokog
obrazovanja, same univerzitete i fakultete, ali i studentsku populaciju,
koja je bila okosnica ovog istraživanja.
Knjiga počinje s odličnim uvodom koji pruža pregled savremenih istraživanja seksualnog uznemiravanja i seksualnog nasilja na fakultetima
iz celog sveta: od Amerike, Afrike, Azije, Australije, zemalja Evrope, do
pregleda situacije u Srbiji.
Prelazi se na istraživanje, koje je utemeljeno na odlično razvijenoj
metodologiji, od definisanja uzorka, ključnih koraka za uspostavljanje
kvalitetne saradnje sa odabranim fakultetima, do povratnih informacija
od kontakt osoba sa svakog fakulteta o procesu prikupljanja podataka, što
su nesebično podeljene i važne lekcije za sve koji će se odvažiti na sličan
poduhvat.
Istraživanje je obuhvatilo ne samo ključna pitanja prevalence i incidence seksualnog uznemiravanja i seksualnog nasilja na fakultetima,
načine viktimizacije i učinioce, nego i posledice preživljenog seksualnog
nasilja, potrebe žrtava, faktore koji utiču na izloženost seksualnom nasilju, stavove prema seksualnom nasilju. Nije izostavljeno ni poznavanje
postojećih mehanizama zaštite, postupaka prijave preživljenog nasilja,
nego se otišlo i korak dalje da se traže mišljenja studentkinja i studenata
o tome šta je nužno učiniti kako bi se seksualno nasilje na fakultetima

suzbilo, osobe koje su ga preživele dobile pomoć, podršku, ali i došle do
pravde, kroz sankcionisanje učinilaca.
Istraživanje je sprovedeno od marta do maja 2021. godine, uključilo
je 1579 studentkinja i studenata sa 22 fakulteta (6 univerziteta), pažljivo
odabranih po geografskoj rasprostranjenosti u Srbiji, ali i po uključivanju
fakulteta različitih naučnih disciplina. Sve učesnice i učesnici istraživanja
imali su priliku osetiti ozbiljnost etičkog pristupa – od informisanog pristanka, do pružanja informacija o postojećim službama kojima se mogu
obratiti za pomoć i podršku nakon popunjavanja online ankete. Naravno,
nije izostavljena ni prijava istraživanja i istraživačkog instrumenta Etičkom odboru Viktimološkog društva Srbije. Isto tako neće izostati ni javno
informiranje svih sudionica i sudionika istraživanja o rezultatima.
Rezultati su prikazani pregledno, naučno, ali i pažljivo, naglašavajući
mesta u kojima postoje određene metodološke dileme, bez obzira na sprovedene statističke obrade.
Posebnost ove knjige čine konkretni primeri kroz citate šest osnovnih
grupa seksualnog uznemiravanja i nasilja, odabrani s merom.
Međutim, osim samih rezultata istraživanja, koje će svakako biti jedno od temeljnih u Srbiji i regionu u narednom periodu, posebnost ove
knjige čine preporuke u cilju prevencije seksualnog nasilja na fakultetima, koje su duboko utemeljene na rezultatima istraživanja, podeljene u
nekoliko kategorija, jasne i sažete tako da ih svako ko je zainteresovan
može razumeti, ali i primeniti ili se zalagati za njihovu primenu.
Autorkama ove izvrsne knjige prof. dr Vesni Nikolić-Ristanović i dr
Sanji Ćopić želim iskreno čestitati na sprovedenom istraživanju i sjajnoj
knjizi kojoj ćemo se uvek vraćati i na koju ćemo upućivati kada nas sledeći fakultet bude pitao za savet koje sve korake treba preduzeti.

AB  - The paper aims to present so far results of the on going project Sexual violence at the
universities in Serbia: Raising awareness and developing innovative mechanisms of victim
support, implemented by Victimology Society of Serbia. The project consists of two parts: 1.
Review of so far survey findings worldwide and conducting of victimisation survey in Serbia
aimed at gathering data on the extent and forms of sexual violence against students as well as
existing university policies and victim support; 2. Evidence-based intervention aimed at
building capacity of university staff for proper response to sexual violence against students,
strengthening existing policies and practices at the universities related to sexual violence, and
establishing cooperation among universities and victim support services in order to secure
timely support for victims. Victimisation survey was conducted online from March to May
2021 on a sample of 1597 students from four university centers in Serbia. Main findings of
previous surveys conducted worldwide, as well as methodology, challenges in conducting the
survey during pandemic and preliminary findings of the survey in Serbia will be presented.
The focus will be on findings about prevalence, forms of violence and particularly vulnerable
groups of students.

AB  - Research globally shows high levels of sexual violence (SV)
at universities, which encompasses a wide range of acts: verbal
comments and requests, non-verbal displays, quid pro quo acts,
unwanted physical contact and rape. It has serious consequences
for mental and physical health of students, including their
academic achievements. Few studies in Serbia suggest that SV is
present at the universities, but this topic is still under-researched.
Serbian universities are often underequipped to recognize SV
and provide support to victims; consequently, students are
not encouraged to report and seek assistance. In order to raise
awareness about SV at the universities and better equip Serbian
universities to prevent and tackle cases of SV and support
victims, Victimology Society of Serbia implement the project
Sexual violence at the universities in Serbia: Raising awareness
and developing innovative mechanisms of victim support. The
project consists of two parts: research aimed at gathering data
on extent and nature of SV against students at the universities
and existing university policies and care pathways, and evidencebased intervention aimed at building capacity of university staff
for proper response to SV cases, strengthening existing policies

and practices at the universities related to SV, and establishing
cooperation among universities and victim support services
in order to secure timely support for victims. Research was
conducted online from March to May 2021 on a sample of 1597
students in four university centers in Serbia. Data on students’
experiences of SV victimization, their awareness about SV and
existing mechanisms for assistance and support were collected.
The aim of the round table is to present the project, and to focus
on so far challenges and results through sharing experiences in
data collection, some methodological issues and preliminary
research findings, as well as challenges in developing and applying
mechanisms for addressing cases of SV against students.

present at the universities, but this topic is still under-researched.
Serbian universities are often underequipped to recognize SV
and provide support to victims; consequently, students are
not encouraged to report and seek assistance. In order to raise
awareness about SV at the universities and better equip Serbian
universities to prevent and tackle cases of SV and support
victims, Victimology Society of Serbia implement the project
Sexual violence at the universities in Serbia: Raising awareness
and developing innovative mechanisms of victim support. The
project consists of two parts: research aimed at gathering data
on extent and nature of SV against students at the universities
and existing university policies and care pathways, and evidencebased intervention aimed at building capacity of university staff
for proper response to SV cases, strengthening existing policies

and practices at the universities related to SV, and establishing
cooperation among universities and victim support services
in order to secure timely support for victims. Research was
conducted online from March to May 2021 on a sample of 1597
students in four university centers in Serbia. Data on students’
experiences of SV victimization, their awareness about SV and
existing mechanisms for assistance and support were collected.
The aim of the round table is to present the project, and to focus
on so far challenges and results through sharing experiences in
data collection, some methodological issues and preliminary
research findings, as well as challenges in developing and applying
mechanisms for addressing cases of SV against students.",

AB  - In 2018 Serbia took part in the Comparative Study of Student Attitudes towards Punitiveness and Gay and Lesbian Issues that encompasses ten European and non-European countries. The data is collected with the use of a standardized questionnaire, while respondents are students who could work in the criminal justice system. In Serbia, the survey was conducted on a sample of 188 students of the third and fourth year of the undergraduate studies at one state and one private university in Belgrade, including three faculties: Faculty of Special Education and Rehabilitation, Faculty of Philosophy Department of Psychology, and Faculty of Law. Along with other questions, the questionnaire consisted of three scales of attitudes: towards lesbians and gay men, crime, and criminal sanctions. The paper aims at presenting a part of the survey findings concerning students’ penal attitudes. The paper will start with a brief overview of the research methodology. This will be followed with presenting findings of students’ penal attitudes and contributing factors, particularly focusing on gender and victimization experience. Additionally, we will analyse if more punitive attitudes are accompanied with more negative attitudes towards lesbians and gay men. In the final part, we will point out to main conclusions and recommendations.

condusions are pointed out, aswellas recommendations relat­ ed to the necessity of raisingawareness about the rights of per­ sons of different sexual orientation in the field of higher educa­ tion and the importance of sensitizing future professionals who couldwork in the criminaljustice system.

Violence against Women and Teaching at Higher Education Institutions in Serbia

It aims to present first steps in introducing the topic of violence against women in higher education institutions in Serbia as well as to present results of exploratory research about the current situation regarding the place that violence against women as a topic has in teaching at the selected higher education institutions in Serbia. In the first part of the paper, the first time inclusion of this topic in one criminology textbook and the syllabi at the Law Faculty (University of Nis) in 1998, and later (2004) at the Faculty for special education and rehabilitation - FASPER (University of Belgrade) is described. The importance of the cooperation of the author of this paper and professor Slobodanka Konstantinovic Vilic, persons and circumstances that were beneficial for their ideas to be realized, as well as further development of teaching about violence against women at these faculties is emphasized. In the second part of the paper current state of teaching about violence against women at the Law Faculty (University of Nis) and FASPER is examined within a larger context of the situation at similar faculties in Serbia. The analysis is focused on the visibility of the violence against women topic in the syllabi of the faculties of three state universities: University of Belgrade, University of Nis and University of Novi Sad. Apart from the Nis Law Faculty and FASPER, the analysis included the law faculties of the University of Belgrade and University of Novi Sad, as well as Special education and rehabilitation studies at the Faculty of Medicine in Novi Sad. The analysis is based on the data contained in the syllabi (undergraduate, master and doctoral level) that were available online on the internet sites of the given faculties in October 2018. Qualitative analysis of the syllabi was performed. It included the following data: course title, goals, outcomes, content and reading materials. The results suggest that violence against women topic is included in teaching at the majority of the faculties encompassed by the study, while at the same time there is inconsistency in dealing with different forms of violence. The topic of domestic violence is the most common, while sexual violence and trafficking in people (women) are less present. Some faculties have courses specifically dealing with either domestic violence or trafficking in people. Other forms of violence against women, such as stalking, work-related abuse and violence against women in general, are rarely present in syllabi, i.e. only at certain faculties. We can assume that these topics are only sporadically taught, or are not taught at all. The topic of violence against women is most prominent in undergraduate level syllabi, while it is somewhat less represented on the master level and in doctoral studies. However, on the other side, some master courses are completely or largely devoted to topics related to violence against women (e.g. courses called Domestic violence and Trafficking in people). The main weakness is the fact that most of the courses that have violence against women as a part of their syllabi are optional courses, which means that all students are not educated for adequate dealing with violence against women in their future practical work. Based on the study results, the author concludes that the current situation regarding the inclusion of the violence against women topic is better than twenty years ago. However, it is necessary to conduct larger and more detailed study in order to give reliable estimation of whether education that future professionals obtain at faculties in Serbia is appropriate to assure adequate social response to violence against women in terms of its suppression, prevention and victims support.

Podrška žrtvama u izabranim državama Balkana: Komparativna perspektiva

AB  - Komparativna analiza podrške žrtvama pripremljena je u cilju sticanja
znanja o načinu uređenja i funkcionisanju podrške žrtvama u izabranim
državama Balkana: Srbiji, Hrvatskoj, Bosni i Hercegovini, Crnoj Gori i
Makedoniji. Izabrane su države koje dele isto pravno nasleđe, jer su bile
u sastavu Socijalističke Federativne Republike Jugoslavije, imaju sličan
sistem pravosuđa i dele slična iskustva vezana za razvoj podrške žrtvama.
Iskustva Hrvatske, kao poslednje države koja je pristupila Evropskoj uniji
(EU) (2013), značajna su za druge države regiona, koje su u procesu pregovaranja
o pristupanja EU (Srbija i Crna Gora), imaju status zemlje kandidata
(Makedoniju) ili su potencijalni kandidat za pristupanje EU (Bosna i Hercegovina),
te su u obavezi ili nastoje da usklade svoje zakonodavstvo, politiku
i prakse sa pravnim tekovinama Evropske unije kako bi se osiguralo da žrtve
kriminaliteta dobiju potrebne informacije, podršku i zaštitu.
U ovom izveštaju prikazani su i analizirani nalazi do kojih se došlo triangulacijom
podataka prikupljenih na dva načina: kvalitativnom analizom
normativnog okvira i analitičkih dokumenata o sistemu podrške žrtvama
u izabranim državama i putem empirijskog istraživanja primenom ankete,
koje je obuhvatilo 127 pružalaca podrške žrtvama u izabranim zemljama.
Polazni okvir za analizu podrške žrtvama čine odredbe Direktive EU o
uspostavljanju minimalnih standarda o pravima, podršci i zaštiti žrtava
kriminaliteta (Direktiva EU o pravima žrtava). Fokus analize je na četiri
ključna pitanja: definisanje pojma „žrtva“ u krivičnom zakonodavstvu, definisanje
prava žrtve u krivičnom zakonodavstvu, pravo žrtve na informisanje
o svojim pravima i dostupnim oblicima pomoći, podrške i zaštite, i pravo
na besplatan pristup poverljivim službama za žrtve, pre, tokom i nakon
krivičnog postupka.
Analiza je pokazala da osim u Hrvatskoj i Makedoniji, pojam žrtve nije
definisan u krivičnom procesnom zakonodavstvu ostalih posmatranih
država. U Hrvatskoj, i delom u Makedoniji, žrtva je poseban procesnopravni
subjekt. Kada je u pitanju učešće žrtve u krivičnom postupku, u svim
posmatranim zemljama se ono vezuje za institut oštećenog. Uvođenjem
pojma „žrtva“ i njegovim jasnim razgraničenjem od pojma oštećenog omogućava
se da žrtva bude prepoznata kao poseban procesni subjekt, što je
važno zbog poštovanja prava i zaštite koju bi trebalo jednako garantovati svakoj žrtvi, bez obzira da li će učestvovati dalje u postupku u svojstvu
oštećenog ili ne.
U pogledu definisanja osnovnih prava žrtve u krivičnom procesnom zakonodavstvu
najdalje je otišla Hrvatska, koja je prenela odredbe Direktive
EU o pravima žrtava u svoje nacionalno zakonodavstvo.1 Ovaj
primer treba da slede i ostale posmatrane države. Potrebno je jasno definisati
prava koja žrtva može da ostvari u krivičnom postupku u svojstvu
oštećenog i prava koja žrtvama treba garantovati nezavisno od učešća u
krivičnom postupku.
Pravo žrtve na informacije je ključno za ostvarivanje ostalih prava, ali
to nije prepoznato u svim posmatranim državama. Obaveza pružanja žrtvama
informacija regulisana je pozitivnim propisima Hrvatske i Makedonije,
što je posledica prepoznavanja žrtve kao posebnog procesnog subjekta.
U ostalim posmatranim državama zakonom kojim se reguliše krivični
postupak predviđa se obaveza informisanja žrtve o procesnim pravima ali
samo u situaciji kada svoja prava u postupku ostvaruje kroz institut oštećenog.
Zato je potrebno u zakone ostalih država kojima se reguliše krivični
postupak uvesti striktna pravila kojima bi se na sistematičan način uredila
obaveza obaveštavanja žrtve o pravima kojima raspolaže i to od prvog kontakta
sa nadležnim organom, kao što su policija, tužilaštvo i sud.
Službe za žrtve predstavljaju ključni mehanizam za omogućavanje uživanja
prava žrtava i pomoć žrtvama, te u svim državama obuhvaćenim
istraživanjem podršku žrtvama pružaju organizacije civilnog društva i
državne službe. Kada su u pitanju državne službe, mahom se radi o službama
koje postoje pri pravosudnim organima, odnosno pri tužilaštvima i/
ili sudovima i sigurnim kućama ili prihvatilištima pri ustanovama socijalne
zaštite. Jedino u Makedoniji ne postoje službe za podršku žrtvama pri pravosudnim
organima.
Državne službe pružaju veoma konkretne i fokusirane usluge, koje su
često ograničene na usko definisane grupe korisnika i tokom ograničenog
vremenskog perioda. One najčešće pružaju podršku žrtvama kao
oštećenima i svedocima u krivičnom postupku, dakle, samo licima koja
dolaze u kontakt sa pravosudnim organima i to tokom trajanja krivičnog
postupka, i usluge smeštaja za žene i decu žrtve nasilja, kada su u pitanju
sigurne kuće ili prihvatilišta pri ustanovama socijalne zaštite.
Organizacije civilnog društva pružaju širi krug specijalizovanih usluga
za konkretne ugrožene grupe žrtava i koriste inkluzivniji pristup, što  kontinuitet njihovog rada i nivo usluga koje se pružaju žrtvama na godišnjem
nivou u svim državama obuhvaćenim analizom, pa je zato neophodno
obezbediti stabilno i dugoročno finansiranje usluga podrške žrtvama.
Finansiranje usluga podrške od strane države je ključno za obezbeđivanje
jednakog pristupa službama za sve žrtve na celoj teritoriji države. S tim u
vezi, neophodno je u svim državama obuhvaćenim istraživanjem prethodno
sprovesti analizu fiskalnog uticaja, tj. procene kolika je potreba za ovom
vrstom podrške od strane države i kolika sredstva je potrebno obezbediti
kako bi se osigurala adekvatna podrška žrtvama.
Podeljenost usluga koje pružaju organizacije civilnog društva i državne
službe zahteva uspostavljanje saradnje pružalaca podrške i
koordinaciju postojećih usluga. Umrežavanje i saradnja državnih službi
i organizacija civilnog društva jedan je od optimalnih modela/strategija
uspostavljanja nacionalnog sistema podrške žrtvama. Takav pristup omogućava
kombinovanje podrške žrtvama u okviru i izvan krivičnopravnog
sistema, pružanje usluga za sve žrtve i specijalizovanih vidova podrške,
upućivanje među organizacijama i institucijama koje su uključene u pružanje
podrške. Međutim, takav pristup zahteva precizno regulisanje modela
koordinacije usluga pružalaca podrške žrtvama na nacionalnom nivou.kontinuitet njihovog rada i nivo usluga koje se pružaju žrtvama na godišnjem
nivou u svim državama obuhvaćenim analizom, pa je zato neophodno

AB  - This report examines organization and functioning of victim support
in the selected Balkan countries: Serbia, Croatia, Bosnia and Herzegovina,
Montenegro and Macedonia. Selected countries share the same
legal heritage, their justice systems are similar and they experience similar
challenges in establishing victim support. Experience of Croatia, as the last
state to join the European Union (EU) (2013), is relevant for other countries
in the Balkan region, which are in the process of negotiations on the accession
to the EU (Serbia and Montenegro), have the status of a candidate
country (Macedonia) or are potential EU candidate country (Bosnia and
Herzegovina), and are therefore obliged or committed to harmonize their
legislation, policy and practice with the EU acquis in order to ensure that
victims of crime receive necessary information, support and protection.
The report is prepared by triangulation of data collected in two ways:
by qualitative analysis of the normative framework and analytic reports on
victim support systems in the selected countries and a survey, which consulted
127 victim support services in the observed countries.
The EU Directive on establishing minimum standards on the rights,
support and protection of victims of crime (Victims’ Rights Directive)
served as a framework for the comparative analysis. The focus was on
the following aspects: defining the term ‘victim’ in the criminal legislation,
defining victims’ rights in the criminal legislation, victim’s right to receive
information, and victim’s right to access confidential victim support services
free of charge, before, during and for an appropriate time after criminal
proceedings.
Except in Croatia and Macedonia, the term victim is not defined in the
criminal procedure codes of other observed countries. In Croatia, and
partly in Macedonia, the victim is a separate procedural subject. In all countries
encompassed by the analysis victim’s participation in the criminal
procedure is linked to the institution of the injured party. Introducing the
term ‘victim’ and making a clear distinction from the notion ‘injured party’
enables victims to be recognized as separate process entities. This is important
for respecting rights and protection that should be equally granted
to each victim, regardless of his/her subsequent participation in the
criminal proceedings in the capacity of an injured party. In defining victim’s rights, Croatia has gone far away, due to the transposition
of the Victims’ Rights Directive into its national legislation.2
This should be followed by other countries in the region as well. In this respect,
it is necessary to clearly define the rights that the victim can exercise
in the criminal proceedings in the capacity of an injured party, and the rights
that should be granted to all victims irrespective of their participation
in the criminal proceedings.
Right to receive information from the first contact with a competent
authority is crucial for enabling victims to access other rights; nevertheless,
this right is not recognized in all assessed countries. The
obligation to provide victims information is foreseen in the criminal legislation
of Croatia and Macedonia, which is a direct consequence of recognizing
the victim as a separate entity within the criminal procedure code.
In other countries, obligation to notify victim of his/her rights refers only
to procedural rights when a victim participates in the criminal procedure in
his/her capacity of an injured party. It is therefore necessary to introduce
strict rules that would systematically regulate the obligation to notify the
victim on his/her rights from the first contact with the competent authority,
including the police, the prosecution and the court.
Victim support services are recognized as key mechanisms for enabling
victims to access their rights and assistance and in all observed
countries support is provided by civil society organizations and the
state services. As for the state services, they mainly refer to victim and
witness support services within the prosecutor’s offices and/or courts, and
safe houses or shelters in the social welfare institutions. Only in Macedonia
there are no victim and witness support services within the judiciary.
State services provide very specific and focused services, which are limited
to very narrowly determined users and for a very limited period
of time: support to victims in their capacity of injured parties and/or witnesses
during criminal proceedings, and providing safe accommodation to
women and child victims of violence.
Civil society organizations provide a wider range of services which are
often specialized and targeted to specific vulnerable groups, but they
still have more inclusive approach, which enables victims to get more
forms of assistance at one place. Additionally, civil society organizations
often provide services outside of their premises, they have mobile teams and work after the working hours, which is relevant for accessibility of support
and meeting victims’ needs in a proper way.
Both civil society organizations and state services play an important
role in delivering victim support in all observed countries. Therefore,
it is necessary that finances, standards and policies of victim support are
equally developed in both sectors.
There are few general victim support services in the selected countries.
This category mainly refers to victim and witness support services
in the courts and/or prosecutors’ offices, whose services are limited. An
example of good practice of offering information and referral of all victims
to victim support services is the establishment of the national free line for
victims in Croatia. The analysis also revealed that there is a small number
of specialized support services for child victims in all observed countries.
Support is mainly available to specific type of victims, in particular to
victims of violence: domestic violence, sexual violence, trafficking in
human beings, war crimes and hate crimes. These findings reflect the
process of development of victim support that followed the same trend
in all assessed countries. Therefore, it is necessary to further advocate
for strengthening of existing and establishment of new general victim support
services outside the criminal justice system, so that victim support
could be equally available to victims of all forms of crime and irrespective
of their participation in the criminal proceedings.
Victim support is most often provided locally: in the region or place
where the organization is located. Geographical access to victim support
services in Croatia and Bosnia and Herzegovina is better compared
to Serbia. A Croatian model can be used as an example of a good practice
in establishing a national victim support system: through establishment
of a partner network of civil society organizations in 13 counties, with
the existence of a network of victim and witness services in the courts,
a network of services has been created that provides equal access to support
for all victims. Nevertheless, even in Croatia cooperation and coordination
of services provided by the state, on one hand, and civil society
organizations, on the other, remain rather challenging.
Electronic and printed media and the Internet are important outreach
tools for informing victims of existing victim support services in all
observed countries. The media needs to be further used to inform citizens
about victims’ rights and available services and a range of methods
should be employed. An example of good practice of using the Internet is the Interactive online map of victim support services in Serbia https://victimservices.
eu.
Referral of victims to victim support services is not systematically
regulated in Serbia and Macedonia, while in Croatia and Bosnia and
Herzegovina it is a key way of informing victims about available victim
support. Victims are referred to victim support by the police, prosecutors,
courts and civil society organizations. It is therefore necessary to develop
a referral mechanism between all institutions and organizations involved
in victim support in other observed countries, including Serbia.
Victim support services in selected countries offer minimum support

support, and referral to other relevant service providers. However,
the data also revealed that victims do not always receive complete information
about their rights and available services.

is gaining more attention. Thus, it is important to use new forms of communication
with victims, as well, such as online chat, social media, modern
platforms for communication – Skype, Viber, Whatsapp.

victim support is more spread in Croatia than in other observed countries:
apart from involving volunteers in victim support in civil society organizations,
they are also involved in victim support in victim and witness services
in the courts. This is an example of a good practice and may be used as
a model in other countries as well. This could contribute to the increase
of the number of victims and witnesses who could receive assistance and
support.
The analysis revealed that not all the paid staff and volunteers who
provide victim support in Serbia passed the training for working with
victims. Situation is much better in Bosnia and Herzegovina and Croatia,
where almost all paid staff in organizations covered by the survey have
undergone training for working with victims. In these two countries, all
or almost all volunteers passed the training for working with victims, too.
As foreseen in Article 25 of the Victims’ Rights Directive, both basic and
specialist trainings, as well as entry and ongoing trainings should be provided
to all paid staff and volunteers working with victims. This could ensure
that the rights of victims are respected, that victims receive adequate assistance
and support and are protected from secondary victimization.There is an instability in funding victim support services in all selected
countries. This is especially evident when it comes to civil society organizations,
which are largely dependant on project funding. This negatively
impacts sustainability of services, continuity of their work and the level of
services provided to victims on an annual basis. Therefore, it is necessary
to ensure stable funding for victim support. The state should have a crucial
role in developing necessary funding mechanisms in order to ensure equal
access to services for all victims. In this regard, it is necessary to previously
conduct a financial impact analysis in all countries encompassed by the research
in order to estimate the need for this type of support by the state
and the amount of resources needed to ensure adequate support for all
victims.
To ensure better utilization of resources it is important to establish
cooperation between state and non-state service providers and coordination
of services offered. Networking and cooperation between state
services and civil society organizations is one of the optimal models/strategies
for establishing a national victim support system. Such an approach
allows combining victim support within and outside the criminal justice
system, providing general victim support and specialized services, and
referrals among organizations and institutions involved in victim support.
Such an approach requires a precise regulation of the model of coordination
of victim support services at the national level.

kriminaliteta dobiju potrebne informacije, podršku i zaštitu.
U ovom izveštaju prikazani su i analizirani nalazi do kojih se došlo triangulacijom
podataka prikupljenih na dva načina: kvalitativnom analizom
normativnog okvira i analitičkih dokumenata o sistemu podrške žrtvama
u izabranim državama i putem empirijskog istraživanja primenom ankete,
koje je obuhvatilo 127 pružalaca podrške žrtvama u izabranim zemljama.
Polazni okvir za analizu podrške žrtvama čine odredbe Direktive EU o
uspostavljanju minimalnih standarda o pravima, podršci i zaštiti žrtava
kriminaliteta (Direktiva EU o pravima žrtava). Fokus analize je na četiri
ključna pitanja: definisanje pojma „žrtva“ u krivičnom zakonodavstvu, definisanje
prava žrtve u krivičnom zakonodavstvu, pravo žrtve na informisanje
o svojim pravima i dostupnim oblicima pomoći, podrške i zaštite, i pravo
na besplatan pristup poverljivim službama za žrtve, pre, tokom i nakon
krivičnog postupka.
Analiza je pokazala da osim u Hrvatskoj i Makedoniji, pojam žrtve nije
definisan u krivičnom procesnom zakonodavstvu ostalih posmatranih
država. U Hrvatskoj, i delom u Makedoniji, žrtva je poseban procesnopravni
subjekt. Kada je u pitanju učešće žrtve u krivičnom postupku, u svim
posmatranim zemljama se ono vezuje za institut oštećenog. Uvođenjem
pojma „žrtva“ i njegovim jasnim razgraničenjem od pojma oštećenog omogućava
se da žrtva bude prepoznata kao poseban procesni subjekt, što je
važno zbog poštovanja prava i zaštite koju bi trebalo jednako garantovati svakoj žrtvi, bez obzira da li će učestvovati dalje u postupku u svojstvu
oštećenog ili ne.
U pogledu definisanja osnovnih prava žrtve u krivičnom procesnom zakonodavstvu
najdalje je otišla Hrvatska, koja je prenela odredbe Direktive
EU o pravima žrtava u svoje nacionalno zakonodavstvo.1 Ovaj
primer treba da slede i ostale posmatrane države. Potrebno je jasno definisati
prava koja žrtva može da ostvari u krivičnom postupku u svojstvu
oštećenog i prava koja žrtvama treba garantovati nezavisno od učešća u
krivičnom postupku.
Pravo žrtve na informacije je ključno za ostvarivanje ostalih prava, ali
to nije prepoznato u svim posmatranim državama. Obaveza pružanja žrtvama
informacija regulisana je pozitivnim propisima Hrvatske i Makedonije,
što je posledica prepoznavanja žrtve kao posebnog procesnog subjekta.
U ostalim posmatranim državama zakonom kojim se reguliše krivični
postupak predviđa se obaveza informisanja žrtve o procesnim pravima ali
samo u situaciji kada svoja prava u postupku ostvaruje kroz institut oštećenog.
Zato je potrebno u zakone ostalih država kojima se reguliše krivični
postupak uvesti striktna pravila kojima bi se na sistematičan način uredila
obaveza obaveštavanja žrtve o pravima kojima raspolaže i to od prvog kontakta
sa nadležnim organom, kao što su policija, tužilaštvo i sud.
Službe za žrtve predstavljaju ključni mehanizam za omogućavanje uživanja
prava žrtava i pomoć žrtvama, te u svim državama obuhvaćenim
istraživanjem podršku žrtvama pružaju organizacije civilnog društva i
državne službe. Kada su u pitanju državne službe, mahom se radi o službama
koje postoje pri pravosudnim organima, odnosno pri tužilaštvima i/
ili sudovima i sigurnim kućama ili prihvatilištima pri ustanovama socijalne
zaštite. Jedino u Makedoniji ne postoje službe za podršku žrtvama pri pravosudnim
organima.
Državne službe pružaju veoma konkretne i fokusirane usluge, koje su
često ograničene na usko definisane grupe korisnika i tokom ograničenog
vremenskog perioda. One najčešće pružaju podršku žrtvama kao
oštećenima i svedocima u krivičnom postupku, dakle, samo licima koja
dolaze u kontakt sa pravosudnim organima i to tokom trajanja krivičnog
postupka, i usluge smeštaja za žene i decu žrtve nasilja, kada su u pitanju
sigurne kuće ili prihvatilišta pri ustanovama socijalne zaštite.
Organizacije civilnog društva pružaju širi krug specijalizovanih usluga
za konkretne ugrožene grupe žrtava i koriste inkluzivniji pristup, što  kontinuitet njihovog rada i nivo usluga koje se pružaju žrtvama na godišnjem
nivou u svim državama obuhvaćenim analizom, pa je zato neophodno
obezbediti stabilno i dugoročno finansiranje usluga podrške žrtvama.
Finansiranje usluga podrške od strane države je ključno za obezbeđivanje
jednakog pristupa službama za sve žrtve na celoj teritoriji države. S tim u
vezi, neophodno je u svim državama obuhvaćenim istraživanjem prethodno

in the selected Balkan countries: Serbia, Croatia, Bosnia and Herzegovina,
Montenegro and Macedonia. Selected countries share the same
legal heritage, their justice systems are similar and they experience similar
challenges in establishing victim support. Experience of Croatia, as the last
state to join the European Union (EU) (2013), is relevant for other countries
in the Balkan region, which are in the process of negotiations on the accession
to the EU (Serbia and Montenegro), have the status of a candidate
country (Macedonia) or are potential EU candidate country (Bosnia and
Herzegovina), and are therefore obliged or committed to harmonize their
legislation, policy and practice with the EU acquis in order to ensure that
victims of crime receive necessary information, support and protection.
The report is prepared by triangulation of data collected in two ways:
by qualitative analysis of the normative framework and analytic reports on
victim support systems in the selected countries and a survey, which consulted
127 victim support services in the observed countries.
The EU Directive on establishing minimum standards on the rights,
support and protection of victims of crime (Victims’ Rights Directive)
served as a framework for the comparative analysis. The focus was on
the following aspects: defining the term ‘victim’ in the criminal legislation,
defining victims’ rights in the criminal legislation, victim’s right to receive
information, and victim’s right to access confidential victim support services
free of charge, before, during and for an appropriate time after criminal
proceedings.
Except in Croatia and Macedonia, the term victim is not defined in the
criminal procedure codes of other observed countries. In Croatia, and
partly in Macedonia, the victim is a separate procedural subject. In all countries
encompassed by the analysis victim’s participation in the criminal
procedure is linked to the institution of the injured party. Introducing the
term ‘victim’ and making a clear distinction from the notion ‘injured party’
enables victims to be recognized as separate process entities. This is important
for respecting rights and protection that should be equally granted
to each victim, regardless of his/her subsequent participation in the
criminal proceedings in the capacity of an injured party. In defining victim’s rights, Croatia has gone far away, due to the transposition
of the Victims’ Rights Directive into its national legislation.2
This should be followed by other countries in the region as well. In this respect,
it is necessary to clearly define the rights that the victim can exercise
in the criminal proceedings in the capacity of an injured party, and the rights
that should be granted to all victims irrespective of their participation
in the criminal proceedings.
Right to receive information from the first contact with a competent
authority is crucial for enabling victims to access other rights; nevertheless,
this right is not recognized in all assessed countries. The
obligation to provide victims information is foreseen in the criminal legislation
of Croatia and Macedonia, which is a direct consequence of recognizing
the victim as a separate entity within the criminal procedure code.
In other countries, obligation to notify victim of his/her rights refers only
to procedural rights when a victim participates in the criminal procedure in
his/her capacity of an injured party. It is therefore necessary to introduce
strict rules that would systematically regulate the obligation to notify the
victim on his/her rights from the first contact with the competent authority,
including the police, the prosecution and the court.
Victim support services are recognized as key mechanisms for enabling
victims to access their rights and assistance and in all observed
countries support is provided by civil society organizations and the
state services. As for the state services, they mainly refer to victim and
witness support services within the prosecutor’s offices and/or courts, and
safe houses or shelters in the social welfare institutions. Only in Macedonia
there are no victim and witness support services within the judiciary.
State services provide very specific and focused services, which are limited
to very narrowly determined users and for a very limited period
of time: support to victims in their capacity of injured parties and/or witnesses
during criminal proceedings, and providing safe accommodation to
women and child victims of violence.
Civil society organizations provide a wider range of services which are
often specialized and targeted to specific vulnerable groups, but they
still have more inclusive approach, which enables victims to get more
forms of assistance at one place. Additionally, civil society organizations
often provide services outside of their premises, they have mobile teams and work after the working hours, which is relevant for accessibility of support
and meeting victims’ needs in a proper way.
Both civil society organizations and state services play an important
role in delivering victim support in all observed countries. Therefore,
it is necessary that finances, standards and policies of victim support are
equally developed in both sectors.
There are few general victim support services in the selected countries.
This category mainly refers to victim and witness support services
in the courts and/or prosecutors’ offices, whose services are limited. An
example of good practice of offering information and referral of all victims
to victim support services is the establishment of the national free line for
victims in Croatia. The analysis also revealed that there is a small number
of specialized support services for child victims in all observed countries.
Support is mainly available to specific type of victims, in particular to
victims of violence: domestic violence, sexual violence, trafficking in
human beings, war crimes and hate crimes. These findings reflect the
process of development of victim support that followed the same trend
in all assessed countries. Therefore, it is necessary to further advocate
for strengthening of existing and establishment of new general victim support
services outside the criminal justice system, so that victim support
could be equally available to victims of all forms of crime and irrespective
of their participation in the criminal proceedings.
Victim support is most often provided locally: in the region or place
where the organization is located. Geographical access to victim support
services in Croatia and Bosnia and Herzegovina is better compared
to Serbia. A Croatian model can be used as an example of a good practice
in establishing a national victim support system: through establishment
of a partner network of civil society organizations in 13 counties, with
the existence of a network of victim and witness services in the courts,
a network of services has been created that provides equal access to support

at large. First systematized scientific papers and empirical research in the field of victimology, as well as first initiatives
for improvement of the position of victims in Serbia occurred in 1980s, with feminists having an important role in both.
During 1990s the influence of other factors was added: initiatives of human rights organisations, development of victimology
as an academic discipline, increase of crime, ethnic conflicts on the territory of the former Yugoslavia and related humanitarian
initiatives. Advocacy of civil society contributed to a great extent to the changes of the state’s relationship toward victims’ issues
that occurred only after political changes in 2000. Since 2012, in the context of the EU accession process and harmonization of
Serbian legislation and policy with the EU aquis, more favourable climate for wider social acceptance of a holistic approach to
the rights of all victims and their support and assistance has been created. This paper will present an overview and analysis of
development of victimology and the victims’ rights movement in Serbia, as well as to evaluate it bearing in mind larger context
of development as well as current status of victimology and advocacy for victims’ rights. Victimology and the victims’ rights
movement in Serbia will be presented following the development through four periods.

AB  - Intergroup communication is an important aspect of dealing with intergroup conflicts in postconflict
societies, including countries of the former Yugoslavia. Widespread monolithic and
authoritarian communication is one of the main obstacles to constructive communication about
the past in the former Yugoslavia, and the challenges involved in shifting the nature of
communication, although rarely addressed and explored, seem to be a condition sine qua non of
effective reconciliation efforts. This should include contact and communication issues as well as
the very process through which the shift from authoritarian (one-way) communication, which
perpetuates conflicts, to inclusive (two-way) communication, which has reconciliatory potential,
can be achieved. Allport’s intergroup contact hypothesis, its revisions and further elaborations
in relation to the use of inclusive communication for overcoming divisions and reaching
reconciliation in post-conflict societies, as well as restorative and transformative justice
literature, including experiences of using yoga as part of restorative justice and reconciliation
programs, can serve as good theoretical departures.
As we explore communication as a way toward reconciliation in post-conflict societies using as
an illustration experiences from the former Yugoslavia, we need to be aware of intergroup
communication on the macro, meso, and micro level and its impact on reconciliation after the
armed conflicts of the 1990s. Conflicts on the macro level include conflicts between the states,
or on the level of the society, while meso-level conflicts are intergroup conflicts; micro-level
conflicts relate to interpersonal conflicts. Also we need to understand the scope and nature of
interethnic and other intercultural conflicts, as well as their socio-historical context and impact
on intergroup communication. Thus, addressing intergroup communication in a constructive and
inclusive way while dealing with the past and implementing reconciliation initiatives is
important. Intergroup communication initiatives that foster reconciliation in particular need to
be identified and explored, as examples of the practice of establishing inclusive communication
and binding people from different ethnic groups and those affected by armed conflicts in
different ways together.

AB  - Četvrto izmenjeno i dopunjeno izdanje knjige "Kriminologija" napisano je
dvadest šest godina posle objavljivanja “Osnova kriminologije”, dvadeset godina
posle objavljivanja prvog izdanja Kriminologije, i petnaest godina posle drugog
izmenjenog i dopunjenog izdanja, i deset godina posle trećeg izmenjenog i
dopunjenog izdanja. U izradi trećeg izdanja Kriminologije ranijim autorkama,
prof. dr Slobodanki Konstantinović – Vilić i prof. dr Vesni Nikolić – Ristanović,
priključila se i prof. dr Miomira Kostić, da bi četvrto izdanje ponovo bilo rezultat
rada samo prve dve autorke.
Autorke predaju, odnosno predavale su studentima osnovnih i doktorskih
studija predmet Kriminologija. Prof. Nikolić - Ristanović predaje na Fakultetu za
specijalnu edukaciju i rehabilitaciju Univerziteta u Beogradu, dok je prof.
Konstantinović – Vilić do odlaska u penziju 2013. godine predavala na Pravnom
fakultetu Univerziteta u Nišu.
Kao i prethodna, i ova knjiga je rezultat napora autorki da studentima
osnovnih i doktorskih studija omoguće saznavanje značajnih tema iz oblasti
kriminologije, vezanih za objašnjavanje fenomenoloških i etioloških karakteristika
kriminaliteta kao negativne masovne, društvene pojave i pojedinačnog ponašanja.
Kroz pet delova knjige: “Pojam, predmet, podela i mesto kriminologije u sistemu
društvenih nauka” (Glava I), “Metode kriminologije” (Glava II), “Fenomenologija
kriminaliteta” (Glava III), “Etiologija kriminaliteta” (Glava IV) i “Viktimološki
pristup objašnjenju kriminaliteta” (Glava V), autorke su nastojale, pored ostalog,
da studentima ukažu na put razvoja kriminološke misli, važnost izučavanja
kriminaliteta, na uticaj koji brze društvene promene ostvaruju na kriminalitet i
dovode do pojave novih oblika kriminaliteta, na zakonodavne i institucionalne
reforme značajne za inkriminisanje nedozvoljenih ponašanja i suzbijanje
kriminaliteta, kao i da upoznaju studente sa najnovijim istraživanjima i novom
literaturom iz oblasti kriminologije.
Najnovije izdanje knjige Kriminologija razlikuje su u odnosu na prethodno
izdanje, pre svega, po tome što je ažurirano u pogledu novina vezanih za
zakonodavstvo, međunarodno pravo i rezultate istraživanja i druge podatke o
kriminalitetu. Kao i ranije, izmene i dopune su izvršene naročito u
fenomenološkom delu u vezi sa obimom, dinamikom, strukturom i novim
pojavnim oblicima kriminaliteta u Srbiji i svetu. Izvršena su i odgovarajuća
usklađivanja i dopune vezane za novo krivično zakonodavstvo i druge mere za
suzbijanje kriminaliteta u Srbiji. Svuda gde je to bilo moguće i smisleno,
izvršeno je ažuriranje statističkih i istraživačkih podataka. Pored toga, zbog
promene vezano za autorke, izvršene su manje izmene u strukturi knjige, neki
delovi su izostavljeni (delovi o zločinima iz mržnje, nasilju u sportu, mobingu i
nasilju prema starim licima), a nekoliko tema, poput terorizma, proganjanja i
interakcionističke teorije, je obrađeno na drugačiji način.

AB  - Restorative justice is implemented in a variety of fields, contexts and situations. One possible way of implementing restorative justice is seen in introducing restorative approaches into the prison settings. It is argued that restorative justice can add more humanity into the prison system; it may help in treatment of prisoners and contribute to their preparation for the release and easier reintegration and social inclusion. Introducing victims' perspective, either through their direct involvement in restorative justice programs in prisons or through working on raising awareness of inmates about victims and their rights, needs and feelings, contributes to increase of the visibility of victims, their empowerment and healing. Taking that as a starting point, the article aims at presenting one possible way of introducing restorative justice into the prison setting through raising awareness programs for prisoners about restorative justice and victims' rights, which are implemented in some European and non-European countries. It particularly focuses on presenting the program on raising awareness about the impact of crime on a victim and on restorative justice, which was developed by the Victimology Society of Serbia as a part of its long-term advocacy and support to female prisoners. This is an integrated, gender-sensitive program developed in the spirit of positive criminology and victimology. It was piloted in 2015 in the women's prison in Serbia. The program was implemented in a form of a series of six workshops followed by evaluation interviews with female prisoners who took part in the entire program. The program evaluation suggested that participants improved their overall knowledge related to victims; they also showed the desire to apologize to person(s) they had hurt and they recognized that the program had influenced them to change in a positive way, especially in terms of diverting from hurting others by a crime or other harmful acts. Participants also recognized the potential of restorative mechanisms in their relationship with their own victims, but also with other people. Evaluation showed that participants used learnt skills after the program ended, particularly communication skills in the spirit of restorative justice, focusing on the present moment and yoga nidra. Development and delivery of the victim awareness raising program piloted in the women's prison in Serbia proved to be valuable learning experience. Keeping in mind lessons learnt, it is obvious that there is a need for broader use of restorative justice approaches in prison settings for both adults and juveniles in Serbia.
